Like Nazi Germany: Federal Court says NYPD can Continue to Stop and Frisk Non-Whites For No Reason - Judge Removed

Movement Regulations/ID Measures. Similar to the changing demographics in the U.S between whites and non-whites - as the number of Jews or more specifically, Semites (non-white people) rose in Nazi Germany, Jews felt the effects of many decrees and regulations that restricted all aspects of their public and private lives. From [HERE] and [HERE] A federal appeals court on Thursday blocked a judge's ruling that found the New York Police Department's stop-and-frisk policy discriminated against minorities, and it took the unusual step of removing her from the case, saying interviews she gave during the trial called her impartiality into question.

 

The city applauded the appeals court's decision. Police Commissioner Raymond Kelly (racist suspect in video), who was shouted down over the tactic by students during a speech at Brown University this week, said he was grateful for it.

"This is indeed an important decision for all New Yorkers and for the men and women of the New York City police department who work very hard day in and day out to keep this city safe," he said.

The 2nd U.S. Circuit Court of Appeals said the ruling by U.S. District Judge Shira A. Scheindlin will be on hold pending the outcome of an appeal by the city. But it may be a nonissue after next week's mayoral election: Democrat Bill de Blasio, who's leading in polls, has said he would drop objections to the ruling, which calls for major changes to the police tactic.

The judge decided in August the city violated the civil rights of tens of thousands of blacks and Hispanics by disproportionally stopping, questioning and sometimes frisking them. She assigned a monitor to help the police department change its policy and training programs on the tactic.

The three-judge panel heard arguments Tuesday. Lawyers in the case said the police department hasn't had to do anything except meet with a monitor since the judge's decision, but the city said police officers are afraid to stop and frisk people now and the number of stop-and-frisks has dropped dramatically.

The appeals panel didn't change the deadline for the appeal and said it expected arguments in March, well after the new mayor takes office.

It said Scheindlin needed to be removed because she ran afoul of the code of conduct for U.S. judges by misapplying a ruling that allowed her to take the case and by giving media interviews and making public statements responding to criticism.

Scheindlin said in a statement later Thursday she consented to the interviews under the condition she wouldn't comment on the ongoing case.

"And I did not," she said.

She said some reporters used quotes from written opinions that gave the appearance she had commented on the case but "a careful reading of each interview will reveal that no such comments were made."

Don't Worry About Jay Z. Stop Shopping at Macy's/Barneys = Stop Supporting White Supremacy

The stores have until November 1 to submit information to Attorney General Eric Schneiderman's office concerning their policies on stopping and detaining customers, calling the police on "suspicious" customers, and policies on anti-discrimination and race, according to letters sent by the attorney general to Barneys Chief Executive Officer Mark Lee and Macy's Chief Stores Officer Peter Sachse.

"Attorney General Eric Schneiderman is committed to ensuring that all New York residents are afforded equal protection under the law. The alleged repeated behavior of your employees raises troubling questions about your company's commitment to that ideal," the letters read. [Do not expect justice, expect white supremacy. At a press conference at the headquarters of the Rev. Al Sharpton's civil rights group, National Action Network, Tuesday morning, Lee responded to the allegations, telling reporters that store officials have conducted an internal investigation of the incidents, and that Barneys has zero tolerance for discrimination.

 From [HERE] Another department store customer came forward Sunday with the fourth “shopping while black” complaint in a week — a customer who says he was surrounded by cops after a legitimate purchase at Macy’s Herald Square in New York. In an eerie echo of the three prior allegations of racial profiling last week, Art Palmer said four plainclothes cops questioned him just three blocks away from the flagship store after he bought $320 worth of Polo dress shirts and ties April 24.

Palmer, a 56-year-old exercise trainer from Crown Heights, Brooklyn, said he made the purchase without incident, using both his Macy’s platinum card and his American Express card.

He was walking to a gym on Park Ave. when police surrounded him and demanded to see his ID. The officers said they were suspicious because they had lost sight of him [probable cause for what offense?] on the store’s surveillance cameras, he said.

“The reason why we stopped you was because you were standing in an area at Macy’s where we could not see you,” one of the officers said, Palmer told reporters Sunday.

When asked if he believed he was racially (targeted) profiled, he said, “There was no other reason.”

He was allowed to continue on his way after he showed his receipt for the duds and the cards with which he purchased them.

Shopping in a White Supremacy System: Black Actor Targeted @ Macys, Searched & Detained for an Hour by NYPD

From [HERE] Barneys isn't the only store being accused of racial discrimination. Now, Macy's has been slapped with a lawsuit implicating the luxury store of racial profiling.

The New York Post reports that actor Robert Brown, who's most known for his starring role opposite Sean Connery in the film “Finding Forrester," has filled a civil suit for an unspecified sum against the luxury retail store and the New York Police Department, citing that he was unlawfully searched by undercover police officers on June 8, 2013. ('The existence of White Supremacy (Racism) automatically eliminates the possibility of any non-white person being so-called "upper-class" or "middle class" in his or her relationship to any person, any place. Such persons are the Powerless Class.' [theCode])

The 29 year old black man, was stopped after making a purchase at the Sunglass Hut store located inside Macy's flagship location in New York's Herald Square.

According to the Manhattan Supreme Court suit, Brown presented his ID to the cops but “was told that his identification was false and that he could not afford to make such an expensive purchase." The Brooklyn resident says he was then arrested and detained by cops for over an hour before finally being released without any charges.

This isn't the first time Macy's has dealt with a racial discrimination lawsuit. In 2005, the company paid New York state $600,000 to settle a complaint that its New York department stores were racially profiling shoppers and unlawful handcuffing them while they were being detained on suspicion of shoplifting.

Brown's incident at Macy's is almost parallel to that of 19-year-old college student Trayon Christian and 21-year-old nursing student Kayla Phillips, who have both filed suits against Barneys and the NYPD this week.

D.C. police officer guilty of assault for use of excessive force on Black Man during 2011 arrest

From [HERE] A D.C. police officer was convicted of assault Wednesday in D.C. Superior court for a January 2011 use of excessive force during an arrest at a Northeast Washington store.

Officer Clinton Turner, 42, was found guilty of simple assault by Judge Robert E. Morin for incident inside the Downtown Locker Room store in the 3900 block of Minnesota Avenue on Jan. 20, 2011 while he was on duty.

Prosecutors said Turner, who was a patrol officer working in the 6th District, exchanged words with a store employee and the employee then walked away from the argument. Turner followed and kept telling the employee “don’t let us get you locked up on your birthday,” prosecutors said.

The victim asked why he would be arrested for being at work doing his job and the officer warned that if he said “something else” he would be arrested, according to prosecutors. The employee sarcastically said “something else” and Turner grabbed the victim and slammed him into a display wall.

Turner then took the victim to the ground by pulling his hair, pulling out clumps of hair, and put him into a choke-hold, prosecutors said.

He is scheduled to be sentenced Nov. 1 on the misdemeanor charge which is punishable by up to 180 days in jail and a $1,000 fine.

Family Files Wrongful Death Lawsuit Against Dallas Police: Witness says Unarmed Black Man Complied with cops before being Shot 7 times

From [HERE] Days after a police shooting that left a mentally ill man in critical condition, another Dallas family whose son was shot by a Dallas Police officer filed a lawsuit against the city and the officer who fired the gun.

Collette Flanagan says she sympathizes with the mother of Bobby Bennett, a schizophrenic man who was shot by Dallas Police in front of his home, after his mother called 911 for help, saying her son was not on his medication and was sitting outside with a knife. Police reported they opened fire because Bennett lunged at them in an aggressive manner, but a neighbor’s surveillance camera shows a different story. Bennett is seen standing still with his arms at his side, when officers opened fire.

“It just made me sick, but thank God there was footage to substantiate that,” Flanagan said.

Her son, Clinton 25, was killed at the hands of a Dallas police officer earlier this year. On March 10th, Dallas Police responded to a disturbance call at an Oak Cliff apartment complex. Police say Officer Clark Staller first tased Allen, then opened fire when Allen began choking him. Allen was found to have PCP in his system. But his family has long disputed that story.

Flanagan says Allen went to his friends apartment to pick up a television. She did not answer the door and he kept knocking. Then she called 911.

The lawsuit states Allen’s friend called 911 “to appease” the male guest she had in her apartment at the time. The lawsuit also states Allen was trying to walk away from the officer to avoid any problems.

“We have a witness who Clinton comply with the instructions given by Officer Staller – clearly comply- had his hands visible. Yet he was just gunned down, shot seven times,” said Daryl Washington, a Dallas attorney who is representing Flanagan.

That witness did not testify in front of a grand jury on Friday, Oct. 11th. A Dallas County Grand Jury declined to indict Officer Clark Staller,  who is white.

Independent autopsy: Black Man Died from Multiple Blows During 10 Minute Beating by Riverside Police - 'his brain was a jar of jelly'

From [HERE] An autopsy found that a Black man who died after a struggle with Riverside police had a boot print on his chest and died from multiple blows and kicks to his head and body, his family’s attorneys said Tuesday, Oct. 22. Raymond Johnson, 41, of Moreno Valley, was pronounced dead shortly after officers in Moreno Valley tried to pull him from his car in the parking lot of a Burger King. A bystander video shows officers repeatedly striking and kicking him.

About a dozen of Johnson’s family members gathered Tuesday in Los Angeles to announce plans to file a wrongful death claim and lawsuit against the Riverside County Sheriff's Department and the six to eight officers involved in the arrest. The department provides police services to Moreno Valley.

One of the family’s three attorneys, Rickie Ivie, said an independent autopsy showed severe blunt-force trauma to his head and injuries from multiple punches and kicks delivered by officers during a 10-minute beating on Oct. 11. Officers also used a Taser and pepper spray on Johnson.

Ivie said the autopsy showed Johnson's brain was “a jar of jelly” as a result of being hit multiple times.

“The real issue is (white supremacy/racism) we don't need to kill someone who is unarmed in order to take them into custody,” Ivie said. “It was not justified to use lethal force. There is no difference between shooting someone and bashing someone's head in.”

Riverside County sheriff's Chief Deputy Patty Knudson (in photo) said the county coroner's autopsy conducted last week did not show that Johnson died from head injuries or blunt-force trauma. She said a cause of death is still undetermined, pending toxicology results.

“The Riverside County Sheriff’s Department is committed to conducting a full and fair investigation, and we invite the results of the independent autopsy to be shared with the Central Homicide Unit investigators,” Knudson said.

"Somethings gotta be done man." White West Memphis Police Officers Beat Handcuffed Black Man 'crying for help'

From [HERE] People in a South Memphis apartment complex say they were eyewitnesses to police brutality. The handcuffed Black victim was crying for help, bleeding and even passed out, all at the hands of three Memphis police officers. Witnesses say police kicked in a door to get Roger Williams out, and bloodstains on the grass shows exactly how badly he was beaten.

“He came up with his hands up. He didn’t say nothing to them! He came up with his hands up,” said Latosha Gardner, who lives in the apartment where police pulled Willams from. “The black officer was just standing back. The three white officers were beating him. So what does that look like?” asked Francia Celstin.

“Repeatedly beating him. They busted his head. They busted his face open,” said Cordarious Pearson, who says he saw the beating through his window.

From [HEREElsa Cruz filed a federal lawsuit in New York this week, months after police shot her husband dead. Last May, Cruz called 911 asking for help with her husband, Samuel. She feared he hadn’t taken his medication while she was on vacation in her native country, the Philippines. Eight months, almost to the day, before Cruz was killed, not far away in Harlem, Hawa Bah called 911 to ask for medical help for her son, Mohamed. Rather than getting medical help, Mohamed Bah was confronted by the New York City Police Department. Within hours, he, too, was shot dead by police, hit eight times, once in the head. Mohamed’s sister, Oumou Bah, is suing the City of New York and unnamed police officers. While neither lawsuit will bring back the dead, they may prevent future deaths by forcing the New Rochelle Police Department and the NYPD to adopt an increasingly mainstream police practice for dealing with emotionally distressed people, called “The Memphis Model.”

Barneys & NYPD Collaborate to Promote White Supremacy: Another Black Shopper Targeted, Detained & Searched

yes, its good to boycott racist stores. From [HERE] Less than 24 hours after the news that Barneys and the New York Police Department are being slapped with a discrimination suit by 19-year-old college student Trayon Christian, the luxury store and the police department are being accused of racial profiling yet again.

Kayla Phillips, a 21-year-old nursing student from Brooklyn, told the Daily News that she was stopped by police after purchasing a $2,500 Céline bag at the store on February 28. After buying the luxury item with the money from a tax return, the woman left the Madison Avenue store. Three blocks away, she says she was surrounded by four undercover police officers -- two white, one African American and one Asian -- at a nearby subway station.

“There were three men and a woman. Two of them attacked me and pushed me against a wall, and the other two appeared in front of me, blocking the turnstile," Phillips told Daily News.

White supremacists/racists control everything in all areas of people activity (economics, education, entertainment, labour, law, politics, religion, sex and war) - 24/7 worldwide.  

Phillips says the white officers, a male and female, questioned her for 20 minutes, inquiring where she lives, why she was in Manhattan and how she was able to purchase such an expensive bag. The mother of one, who is now expecting her second child, told them she was in the borough to shop, showed them her receipt and the card she used. Phillips' debit card was a temporary replacement card, but after showing them her ID and the new, re-issued card she had received that morning in the mail and was carrying in her purse, the officers let her go.

Nevertheless, Phillips has filed a $5 million notice of claim with the city informing them of her intention to sue the NYPD. An additional civil rights lawsuit against the NYPD and Barneys is also pending according to Kareem Vessup, Phillips’ attorney.

While Barneys has tried to distance itself from the accusations with a statement claiming no involvement, these instances have ignited criticism around Jay Z's partnership with the retail store. Jay Z is a "showcase Black" in the system of white supremacy. [MORE]

Florida's Lax Oversight Enables (white supremacy) Systemic Abuse At Private Youth Prisons

From [HERE] Youth Services International confronted a potentially expensive situation. It was early 2004, only three months into the private prison company’s $9.5 million contract to run Thompson Academy, a juvenile prison in Florida, and already the facility had become a scene of documented violence and neglect.

One guard had fractured an inmate’s elbow after the boy refused instructions to throw away a cup, according to incident reports. Another guard had slammed a boy’s head into the floor after an argument. The prison was infested with ants and cockroaches, toilets were frequently clogged and children reported finding bugs in their meager portions of food.

“From day one, it was hell,” said Jerry Blanton, a former monitor with the Florida Department of Juvenile Justice, who was then tasked with inspecting Thompson Academy.

Conditions appeared so foul and perilous that he told his supervisors that he “emphatically recommended that the facility be closed,” according to a memo about the discussions.

What happened next speaks to how Youth Services International has managed to forge a lucrative business running private juvenile prisons in Florida and 15 other states even amid mounting evidence of abuse. The company used connections with state officials to complain that Blanton was intimidating staff. Less than a week later, the state removed him as monitor of the facility. Two months after that, he was fired.

Thompson remained open, and Youth Services International retained its contract to operate it. In the nine years since, the company has won an additional eight contracts in Florida, bringing 4,100 more youths through its facilities, according to state records. All the while, complaints of abuse and neglect have remained constant. [MORE]

ACLU asks Justice to probe Targeted surveillance of Muslims (non-whites) by NYPD

From [HERE] The American Civil Liberties Union asked the Justice Department on Thursday to investigate efforts by the New York City Police Department to conduct surveillance in Muslim communities.

In a letter signed by 125 state and national organizations, the ACLU and the other groups urged the Justice Department’s civil rights division to open a probe of the “unlawful religious profiling and suspicionless surveillance of Muslims in New York City and beyond.”

“Putting a class of Americans under surveillance based on their religion is a clear violation of our Constitution’s guarantees of equality and religious freedom,” said Hina Shamsi, director of the ACLU National Security Project. “The NYPD’s surveillance program has stigmatized Muslims as suspect and had deeply negative effects on their free speech, association and religious practice.”

Citing NYPD documents and a series of investigative articles on the NYPD’s secret intelligence operations by the Associated Press, the ACLU said that New York police have sent paid people to infiltrate mosques, student associations and other places to take photos, write down license-plate numbers and keep notes on people because they are Muslim.

Oakland Using anti-terrorism funding to build a massive surveillance network - to watch You

Lawmakers in Oakland intend to spend millions of dollars awarded to the California city in a federal grant to a police dragnet that promises to examine surveillance footage, riling critics who assert the intention of the grant was to stop terrorism.

When the new program debuts in approximately one year police will be able to track drivers as they travel through tolls, scan license plates with the roughly 3,000 surveillance cameras placed throughout the city, and monitor social media platforms to learn about crimes before they occur. 

The Oakland program, officially referred to as the Domain Awareness Center, according to the New York Times, comes at a time when police departments across the US are using federal money to launch similar surveillance efforts modeled after the New York Police Department. The NYPD, which operates within New York City as well as far outside, has used federal grants to build a massive surveillance network capable of linking cameras and license plate readers to criminal and suspected terrorist databases. 

White LAPD Officer Charged with Felony Assault in Custodial Death of Black Woman - Stomped on Genitals while arms & legs restrained

From [HERE] and [HERE] A white Los Angeles police officer was charged with assault Thursday for allegedly kicking a Black woman, Alesia Thomas, 35, seven times in the groin, abdomen and upper thigh during an arrest in which the woman ultimately died, her attorney said.

According to reports a witness heard the officer threaten to kick the Black woman in the genitals if she did not comply with police orders and then the officer allegedly stomped on the Black woman's genital area. The Black woman was handcuffed and her ankles had been restrained in a “hobble restraint device.” [MORE] The incident was partially captured by video, which has not been released to the public. 

Officer Mary O'Callaghan, an 18-year veteran, was charged by Los Angeles County prosecutors with felony assault under color of authority, lawyer Robert Rico said. O'Callaghan, 48, faces arraignment Tuesday and has been relieved of duty without pay pending an administrative hearing. So far, the media has not shown any pictures of O'Callaghan. 

“I am sad it has taken this long. I am sure Charlie Beck (in above photo) saw this video long ago. I would like to see that video,” said Thomas' mother, Sandra Thomas. “They are charging that officer, but what about all of the officers involved? They did nothing to stop this," she continued. "They didn’t intervene to stop her kicking. They broke the law … maybe they didn’t care just like the officer who kept kicking.”

White prosecutors declined to file a charge of involuntary manslaughter, citing insufficient evidence to prove that the conduct caused Thomas' death, according to the district attorney's office. The assault charge is punishable by up to three years in state prison, prosecutors said.

Six Against One. Unarmed Black Man Beaten to Death by Riverside County Cops after he allegedly Refused to Get Out of Car @ Burger King

From [HERE] and [HERE] Raymond Johnson, 41, was confronted by six or seven Riverside County Sheriff's deputies at 6 p.m. on Friday in the drive-thru exit at a Burger King in Moreno Valley. Investigators told ABC 7 that Johnson was agitated and throwing food and money in and out of the car, and he refused to get out of the car.

Johnson died Friday night, Oct. 11, after he struggled with police and was handcuffed and placed under arrest. ABC 7 obtained video of the struggle that saw six or seven deputies try to get Johnson out of the car while hitting him with what looked like a baton and kicking him. It also appeared that deputies were jumping up and down on Johnson.

Witness Daniel Calderon, who was working nearby, recorded the incident on his cellphone video, KABC-TV said, “We were working and next thing you know we hear yelling and struggling,”  Calderon told the station. “You know, 6 or 7 cops on one guy,” said Calderon.

Johnson died at the hospital. The coroner will determine the cause of death (white supremacy/racism) including if drugs or alcohol were involved.

Study Finds that LAPD Use Police Dogs Only on Blacks & Latinos

From [HERE] A report by the Police Assessment Resource Centre (PARC), a Los Angeles-based non-profit organization, found that in the first six months of 2013, all 17 Los Angeles Sheriff Department (LASD) K-9 unit dog bites were inflicted upon African American and Latino individuals. The report mentioned that between the years of 2004 and 2013, Latino individuals bitten by LASD canines rose 30 per cent (39 individuals bitten), while African Americans bit were increased by 33 per cent (12 individuals bitten).

The report mentions that  the large "minority" populated areas of Century, City of Industry, Compton, Lakewood, and South LA and Lennox incur more dog bites than the all the other 21 districts that the LASD patrols combined.

The US Department of Justice found that in the areas patrolled by the LASD, “African Americans, and to a lesser extent Latinos, are more likely to be stopped and/or searched than whites, even when controlling for factors other than race, such as crime rates.” A report in 2008 by the Los Angeles Times found that “For every 10,000 residents, about 3,400 more black people are stopped than whites, and 360 more Latinos are stopped than whites. Stopped blacks are 127% more likely to be frisked — and stopped Latinos are 43% more likely to be frisked — than stopped whites.”
