Many of the millions who are locked up struggle with mental health issues and drug addiction, low levels of educational attainment, and have histories of unemployment or underemployment.
“For Black males in their thirties, 1 in every 10 is in prison or jail on any given day. A Black male born in 2001 has a 32 percent chance of spending time in prison at some point in his life; a Hispanic male has a 17 percent chance; a White male has a 6 percent chance.
“Solutions include changing draconian “three strikes” and minimum mandatory laws, investing in mental health and drug rehab treatment, reinstating parole and community release, and supporting probation and non-imprisonment alternatives.” [MORE]
From [HERE] Billboards are everywhere in New York City. They’re on subway trains and in stations, and on top of and inside taxis. But few, if any, have been anything like a series of anonymous billboards that have popped up on bus shelters in the Bedford-Stuyvesant neighborhood of Brooklyn. They’re not selling anything but a delcaration: that racism still exists.
A statement on their page states: "Although public commentary describes the United States as "post-racial", racism continues to exert a very real and pervasive influence on institutional policies and processes, interpersonal interactions, neighborhood infrastructure, socioeconomic opportunities, media imagery, and more. RISE is a project designed to illuminate some of the ways in which racism operates in this country." [MORE]

From [HERE] There is a little-known criminal-justice crisis that affects the millions of low-income Americans each year who languish behind bars in city and county jails. On any given day, three-quarters of a million people are jail inmates and two-thirds of them haven't been convicted of anything, according to US Department of Justice statistics. They are awaiting trial, and an estimated 80 percent of them cannot afford to pay bail.
Most won't go to prison: Overall, 95 percent of those booked into local jails in 2010-11 were not subsequently sent to prison, says Timothy Murray of the Pretrial Justice Institute (PJI). And 75 percent of felony defendants will be judged innocent, given probation, or sent to rehabilitation programs and never end up being sentenced to prison, says longtime correctional researcher James Austin.

By denying competent lawyers and suspending due process, the Texas Court of Criminal Appeals runs the fastest assembly line to the death chamber in the country.
A person may be condemned to die in Texas in a process that has the integrity of a professional wrestling match.
An accused may stand virtually defenseless -- facing the death penalty, as his lawyer sleeps through trial; be condemned to die without any adversarial process to determine guilt and punishment; and be denied any post-conviction review, because a lawyer misses a deadline or fails to raise any issues.
The state's highest criminal court, the Texas Court of Criminal Appeals, is not only ignoring constitutional violations (as so many elected judges must do in order to stay in office), but is affirmatively engaged in denying rights to people. The court appoints lawyers incapable of preparing post-conviction petitions and filing them on time and then punishes the condemned inmates for the incompetence of the lawyers it appointed.
United States District Judge Orlando L. Garcia found that the appointment of an inexperienced lawyer with serious health problems to represent Ricky Kerr in post-conviction proceedings "constituted a cynical and reprehensible attempt to expedite [Kerr's] execution at the expense of all semblance of fairness and integrity." n1 Kerr's lawyer had failed to raise a single issue in what one member of the Texas Court of Criminal Appeals, Judge Morris Overstreet, called a "non-application" for post-conviction relief. n2

Jake England, 20, and Alvin Watts, 33, are charged with first-degree murder in what authorities describe as the racially motivated killings of William Allen, Bobby Clark and Dannaer Fields, Black people who were shot over Easter weekend as they walked near their homes on Good Friday.
England and Watts, who also face hate crimes charges, are due to be arraigned Wednesday in district court. Under Oklahoma law, the potential punishment on each of the murder charges is either life in prison with parole, life without parole or the death penalty. The shootings happened in a predominantly black section of Tulsa – not far from where one of the nation's worst race riots happened more than 90 years ago – and all five victims were black.
From [HERE] and [HERE] A 25-year-old white man charged in the pellet-gun shooting of a Black man he "mistakenly thought" was a Muslim showed no remorse and made racist statements even as he was arrested, a detective who investigated the case said Friday. The Pasco County Sheriff's Office has labeled the shooting of Cameron Christopher Mohammed, 24, of Tampa, a hate crime. Mohammed, who was treated at the scene, still has one pellet lodged in his head and one in his neck. He is scheduled to have them surgically removed Monday.
A video released by the sheriff's office shows a man and his girlfriend accosted as they attempted to enter the Walmart at 1575 Land O' Lakes Blvd. shortly after 3 a.m.
Mohammed is a Black man whose parents are from Trinidad, was walking from the store's parking lot with his girlfriend, who is white, when a white man came up from behind and began asking questions.
The suspect asked if the man was from the Middle East and if he was Muslim. After the victim answered "no" to both questions, the suspect called the man a racial slur and made a reference to him being with a "white girl." He said "you're just a nigger with a white girl."
The suspect then pulled a pellet gun from his pocket and fired at least 20 shots at the couple. Even as the suspect left the couple, he aimed the handgun-style weapon at the couple and fired. Two nearby witnesses also saw what took place.

But amid all the celebration, there’s still this inconvenient truth: The Senate is an almost all-white body.
At a time when more than one-third of Americans are nonwhite, just five senators are racial minorities. Digging deeper, there are now more Republican minorities in the Senate (South Carolina’s Tim Scott, Florida’s Marco Rubio, and Texas’s Ted Cruz) than Democrats (New Jersey’s Robert Menendez and Hawaii’s Mazie Hirono). The Democratic coalition relies heavily on overwhelming minority voters' support, but it doesn’t have many leading, prominent nonwhite messengers -- beyond President Obama -- to promote the party's message.

Bev Perdue on Monday pardoned the so-called Wilmington 10, a group whose wrongful conviction on charges of arson and conspiracy to attack firefighters was a human-rights cause célèbre in the 1970s. “I have decided to grant these pardons because the more facts I have learned about the Wilmington Ten, the more appalled I have become about the manner in which their convictions were obtained,” Perdue, a Democrat who leaves office on Jan. 5, said in her Dec. 31 statement.
“Justice demands that this stain finally be removed. The process in which this case was tried was fundamentally flawed. Therefore, as Governor, I am issuing these pardons of innocence to right this longstanding wrong.”
The group was made up of nine black students and activists, and one white antipoverty worker, who were accused of setting fire to a white-owned store and conspiring to fire on police officers and firefighters during several days of riots in February 1971 in Wilmington, N.C., one of the state's last cities to integrate schools.
The Wilmington Ten – nine Black males and one White female – were activists who, along with hundreds of Black students in the New Hanover County Public School System, protested rampant racial discrimination in 1971.
In February of that year, after the arrival of Rev. Benjamin Chavis to help lead the protests, racial violence erupted, with White supremacist driving through Wilmington’s Black community, fatally shooting innocent people and committing arson.
A White-owned grocery store in the Black community was firebombed, and firemen came under sniper fire. It wasn’t until a year later that Rev. Chavis and the others were rounded up and charged with conspiracy in connection with the firebombing and shootings. The 10 were falsely convicted, and sentenced to 282 years in prison, some of which they each served.
From [HERE] Targeted programs for minorities, new farmers, and the environment have been removed from the U.S. Farm Bill as a consequence of significant, under-reported cuts in the deal to avert the so-called “fiscal cliff.” While the deal extended some key Farm Bill provisions, one of which will prevent milk prices from skyrocketing, Senate Minority Leader Mitch McConnell (R-KY) (white man in photo) insisted on cutting these programs as part of the final deal.
Though targeted programs (described as such because they’re “targeted” at helping certain groups of farmers) would have made up only about one percent of the nine-month farm bill extension’s price tag, they make up its most comprehensive and effectual efforts at making American farming sustainable and open to all Americans. Below are three examples of important targeted programs cut at McConnell’s behest:
1. Outreach and Technical Assistance for Socially Disadvantaged Farmers and Ranchers. Because the historical legacy of slavery and discrimination in landowning left the vast majority of American farmland in white hands, African-Americans, Hispanics, and Native Americans are dramatically underrepresented in American farming. Moreover, continued discrimination and unequal education means that white farmers disproportionately benefit from USDA support programs. The Outreach and Technical Assistance program, also known as 2501, is the only federal program dedicated to rectifying this discriminatory legacy by funding grants, education initiatives, and outreach organizations designed specifically for minority farmers. Created in 1990, but more robustly funded in both 2002 and 2008, it has been “most effective in reversing the decline of socially disadvantaged farmers and ranchers across the United States,” according to Professor Robert Zabawa, an expert on race and farming at Tuskegee University. 2501 is strongly supported by a broad group of organizations around the country, including the AFL-CIO.

The bureau said Tuesday that 5.8 million Arabs live in Israel, the West Bank, Gaza and east Jerusalem. That compares to about 6 million Israeli Jews, according to Israeli data.
It said that based on current birth rates, the two populations would be equal in 2016, and in 2020, Arabs would outnumber Jews by 7.2 million to 6.9 million.
The demographic issue is a main argument for Israeli backers of creation of a Palestinian state. They say relinquishing control of the Palestinian territories and its residents is the only way to ensure Israel's future as a democracy with a Jewish majority.

Rand Paul (R – KY) and Mike Lee (R – UT), the Fourth Amendment Protection Act, an attempted amendment to the 2012 FISA Reauthorization Act, has failed in dramatic fashion, with 79 votes against and only 12 in favor.
The amendment was aimed at covering up a loophole which allows the US to spy on emails and text messages, insisting such surveillance could only come with a warrant from a judge.
Paul argued that the law should treat email and text messages exactly the same as phone calls, saying each deserved identical protection. Sen. Dianne Feinstein (D – CA), who led the opposition, insisted that the amendment would keep security forces from stopping terrorism.
Another amendment, which didn’t explicitly curb surveillance but instead sought to make the Attorney General go public on certain types of surveillance decisions, also failed 54-37.

From [HERE] A 31-year-old Latino woman was arrested on Saturday and charged with a hate crime in connection with the death of a man who was pushed onto the tracks of an elevated subway station in Queens and crushed by an oncoming train.
The woman, Erika Menendez of the Bronx, has been charged with second-degree murder as a hate crime, Richard A. Brown, the Queens district attorney, said. “The defendant is accused of committing what is every subway commuter’s nightmare,” Mr. Brown said in an interview. “Being suddenly and senselessly pushed into the path of an oncoming train.”
Mr. Brown quoting Ms. Menendez as telling the police, “I pushed a Muslim off the train tracks because I hate Hindus and Muslims ever since 2001 when they put down the twin towers I’ve been beating them up.” Ms. Menendez conflated the Muslim and Hindu faiths both in her comments to the police and in her target for attack, officials said. The victim, Sunando Sen, was born in India and, according to a roommate, was raised Hindu.
Melendez herself is a victim of white supremacy because she is non-white. Whereas she may be guilty of committing this murder - white supremacy is responsible for it. In any socio-economic system dominated by white supremacists (racists), the White Supremacists are responsible for all unjust acts committed by persons who are subject to the power of White Supremacists. Hollywood directors Quentin Tarantino and Spike Lee are at the centre of a war of words, following Quentin’s new racist movie Django Unchained. The film centres around slavery and uses the N word on a number of occasions, which has hit a raw nerve with Spike, who claims the movie is disrespectful to his ancestors.
Lee explained, “I am not going to see it (the film). I am not seeing it. It would be disrespectful to my ancestors to see that film.” He then took to his official Twitter account to add, “American slavery was not a Sergio Leone Spaghetti Western. It was a Holocaust. My ancestors are slaves. Stolen from Africa. I will honour them.”
However, Tarantino has now hit back, saying, “I think it's kind of ridiculous (the criticism), because no one can actually say with a straight face that we use the word more than it was used in 1858 in Mississippi. So since they can't say that, what they're basically (saying) is I should lie. I should pretty it up. I should lie, and I don't lie when it comes to my characters and the stories I tell.” [MORE]

From [HERE] I had a pretty good idea of where “Django Unchained” was going from the first credit. It went to the Weinstein Company. The Weinstein Company once fought a legal battle (settled out of court) over the right to distribute “Precious,” which is, in my opinion, the worst film ever made about black life. The company’s name in the credits for “Django” also meant that the movie was aimed at a mainstream audience.
Though German, the bounty hunter character played by German-Austrian actor Christoph Waltz seemed to speak with a British accent, which is all the rage in the media, though I need subtitles to understand what Piers Morgan is saying half the time. The German dentist dazzles the screen with his eloquent talk and vocabulary and puts together constructions like “shan’t.” I would loved to have been present at the marketing meetings about this movie. The cynicism must have been as thick as cigar smoke. Jamie Foxx has been promoted as the star of “Django Unchained,” and has assumed the role as movie defender–the same role played by Viola Davis in the promotion of the equally offensive “The Help.” Foxx serves as a buffer between the producers and the wrath of blacks like those who attended a recent showing where the film’s writer and director Quentin Tarantino reportedly faced hostile questions from a black audience.
No White Christmas Either Part 2 From [HERE] Still reeling the election day destruction from the collapse of "Don't Re-Nig in 2012" a white man in Kentucky is defending his roadside display of a watermelon-holding mannequin wearing a President Obama mask, saying the First Amendment protects the offensive spectacle.
“The way I look at it, it’s freedom of speech,” Danny Hafley, a Neuropean (a neurotic, stupid and self-deluded white supremacist Caucasian or Fascist [MORE]) of Casey County told Lex 18 News. “I don’t know how other people will take it.” Hafley said he gave the watermelon to the racially charged effigy he calls his “buddy” because it “might get hungry standing out here.”
“He don’t talk. Don’t make no smart comments,” he said. “If I had a dollar for everyone who stopped and took a picture of it, I’d be a millionaire.”
Hafley put the display up around Election Day and told the television station earlier this week that he doesn’t plan to take it down anytime soon. At least one neighbor wasn’t happy about it.
“We don’t have black people in this community, but I’m sure they travel this road like everybody else does,” the anonymous woman told Lex 18. “They could be offended. I don’t agree with it.” She also said the display initially included a sign that suggests Obama may destroy the country.
Police say nightclub manager Antoine Jones was the ringleader of a cocaine trafficking operation, and they had enough evidence to convince a jury he was guilty. There's just one problem: a key part of the government's case came from a GPS tracking device the police secretly attached to Jones' car. Jones argues that the installation and use of the device violated his Fourth Amendment rights. [MORE] From [HERE] Prosecutors in Washington this evening can rest easier. A judge declined to rule out as evidence the hundreds of thousands of dollars in cash and cocaine that the government wants to connect to Antoine Jones, the man who was at the center of the landmark GPS surveillance case in the U.S. Supreme Court.
The high court earlier this year voided the GPS data the government relied on at trial to link Jones to a drug stash house in Maryland. But that left open whether the government would be allowed to tell jurors all about the stuff that was found in the residence.
Ruling for the government this evening, U.S. District Judge Ellen Segal Huvelle said federal agents—a day before the installation of the tracking device in September 2005—determined the likely location of the drug house in Maryland. The judge's ruling is here.
Huvelle also said that even if Jones "could demonstrate a causal nexus between the GPS data and the location of the stash house," the government wins under the "inevitable discovery doctrine." The prosecution's evidence: $850,000 in cash and 97 kilograms of powder cocaine.
From [HERE] A US Marine has had his rank reduced and been fined $500 fine for urinating on corpses of Taliban fighters in Afghanistan after pleading guilty at a special court martial in Camp Lejeune, North Carolina.
Staff Sgt Joseph W. Chamblin pleaded guilty to charges of wrongful desecration, failure to properly supervise junior Marines and posing for photographs with battlefield casualties.
Footage of the incident, which occurred during a counter-insurgency operation in Afghanistan's Helmand Province in July 2011, quickly went viral after it was uploaded to the Internet in January this year, sparking world-wide outrage.
The video shows four Marines in uniform laughing and joking while urinating on the bodies of three bearded men. One of the men says, "Have a nice day, buddy." A caption identifies them as members of Scout Sniper Team 4.
US Defense Secretary Leon Panetta called the Marines' behaviour "utterly deplorable" and promised an investigation, while Afghan President Hamid Karzai condemned the actions as "inhuman". US Secretary of State Hillary Clinton also promised that the Marines would be punished after expressing her "total dismay".
However, following an eight-month investigation, the Marine Corps decided on undisclosed administrative punishments for three of the Marines in August. All three had pleaded guilty to misconduct charges, including "wrongly video-recording" the incident, failing to report it, as well as posing next to the bodies.
