From [HERE] The white man who shot 25-year-old Ahmaud Arbery while he was jogging on a residential street allegedly called him the n-word after the fatal incident, investigators said Thursday. 

During a probable cause hearing in Brunswick on Thursday for three men accused in Arbery’s Feb. 23 slaying, Georgia Bureau of Investigation Special Agent Richard Dial revealed that Travis McMichael called Arbery a “fucking  n---er” as Arbery lay on the ground with three gunshot wounds.

Dial said eyewitness and co-defendant William Bryan Jr., who has also been charged with murder, reported hearing the slur. It was also captured on video.

McMichael, 34, and his father Gregory, 64, are facing murder and aggravated assault charges for allegedly chasing down and killing Arbery. Bryan, the man who recorded the shocking viral video of Arbery’s death, was charged with felony murder and criminal attempt to commit false imprisonment. A judge ruled after Thursday’s preliminary hearing that there was enough evidence to proceed with trying the three men on murder charges.

The slaying—which many have described as a “lynching”—and the subsequent investigation prompted a Department of Justice investigationand triggered a national outcry that has spilled over into protests about the death of George Floyd. 

The GBI alleges that on Feb. 23, the McMichaels and Bryan armed themselves with a shotgun and a .357 Magnum as they pursued a man they suspected of being involved in a string of break-ins in the Satilla Shores neighborhood.

Dial revealed new details on Thursday about the lead-up and aftermath of the shooting. He said that on Feb. 23, Arbery—who was often seen jogging in the neighborhood—had come out of a home under construction, without stealing anything, and continued jogging down a street about two miles from his home. (The construction site owner, Larry English, has previously said it it looked like Arbery was looking for water, according to motion sensor cameras.) 

When Gregory saw Arbery “hauling ass” down their street in Satilla Shores, he called out to his son to help chase him, Dial said. Bryan was outside his residence at the time and got in his truck to assist in the pursuit. [MORE]

Black writer Adam Harris observed, “The current demonstrations against police brutality will end. They always do. When the crowds go home, politicians will resume their defensive crouch. In fact, “On Tuesday, Senator Rob Portman of Ohio called for a national commission on race to have “a robust and inclusive national dialogue on racial inequities.” He hoped it could be packed with individuals such as former Presidents George W. Bush or Barack Obama who “have spoken eloquently about racism as a stain on our national character.” Harris warns that such work is really the work of eye-servants [folks who want to look like they are doing something] who “will issue informed and well-meaning recommendations. In 1968 Howard Zinn similarly observed that despite “an endless succession of Civil Rights Laws” and Black appointments to high positions in all branches of government, “the processes of government have not been sufficient to change the plight of the black person in America.” While noting that Black protest had launched a so-called “social revolution” he explained that the protests “have obviously not been sufficient to do more than make people conscious of their own ineptitude inside the old channels; hence the eruption of riot and rebellion in the cities.”

In regard to liberal hopers looking toward the alleged “power and vitality” of the electoral process, Zinn explained that they “are living in an antiquated romantic dream very far from political reality. The people of Harlem, of the South Side of Chicago, and the ghetto of Detroit, unlike black people in the South, have been participating in electoral politics for a long time, have elected black Congressmen and city officials, but their basic condition has remained the same. It would seem from the evidence, that whether black or white people occupy the posts of the American political structure, there is something about that structure itself which does not permit the necessary changes to take place.” Zinn further states:

Evidence comes from the governments own reports, the Kerner Commission itself: The frustrations of powerlessness have led some Negroes to the conviction that there is no effective alternate to violence as a means of achieving redress of grievances. It talks of a widespread belief among Negroes in the existence of police brutality and in a double standard of justice and protection one for Negroes and one for whites. Remember the Commission is speaking here of Northern urban Negroes, who have had access to the electoral process and all the other channels Mr. Fortas talks about. Ghetto residents, the Commission reports, increasingly believe that they are excluded from the decision making process which affects their lives and community. It goes on to say: The political system has not worked for the Negro as it has for other groups.

“A little historical perspective might dull some of the glow Fortas casts over our systems capacity to deal with the race problem. We have had all the constitutional guarantees he speaks of, and the vaunted electoral process for a very long time; since 1870 we have had all that plus the specific guarantees of the 14th and 15th amendments and a series of powerful civil rights acts passed in 1867. And we have had the demonstrative actions of fourteen intense years, from the Montgomery Boycott of 1955 to the Poor Peoples Campaign of 1968. And after all that we have had the largest outbreaks of protest in the black ghettos.

Of course, one can point to gains. But so could the South of pre-1954; it also insisted its channels were effective, that militant action by Negroes was not required. The crucial point is: Are those gains adequate for the times in which we live, for the expectations that people have the right to hold in these times?

Dr. Kenneth Clark applied some of the needed perspective when he told the Kerner Commission:

“I read that report of the 1919 riot in Chicago, and it is as if I were reading the report of the investigating committee on the Harlem riot of 35, the report of the investigating committee of theHarlem riot of 43, the report of the McCone Commission on the Watts riot.

I must again in candor say to you members of this Commission it is a kind of Alice in Wonderland with the same moving picture re-shown over and over again, the same analysis, the same recommendations, and the same inaction.” [MORE]

Hiding the violence under layers of complex rituals and self-contradictory rationalizations, and labeling brute thuggery as virtue and compassion, does not change that fact. Claiming noble goals, saying that the violence is “the will of the people,” or that it is being committed “for the common good” or “for the children,” cannot change evil into good. “Legalizing” wrong does not make it right. Authorities Attempt to Remanufacture Social Relations w/the Public Using Image of Black AG Announcing 2nd Degree "Unintentional Murder" Charge & Mug Shots of Other Cops Charged as Accessories

Minnesota Attorney General Keith Ellison announced Wednesday that he is upgrading the charges against former Minneapolis police officer Derek Chauvin to second-degree murder in George Floyd’s killing and will also filed criminal complaints against officers Thomas Lane, J. Alexander Kueng and Tou Thao charge each of them with one count of aiding and abetting second-degree murder, and one of aiding and abetting second-degree manslaughter. 

Former Minneapolis police officer Derek Chauvin had initially been charged with third-degree murder. A third-degree murder is an unintentional killing which results from an act eminently dangerous to others that is done with a wanton and willful disregard of an unreasonable risk to human life.

NO INTENT TO KILL HERE? The complaint says the white cop intended to commit a felony assault and while doing so he unintentionally killed Floyd. HE also KNEW HE WAS BEING RECORDED & DIDN’T GIVE A FUCK. WILL MORE BODYCAMS BE APART OF THE NEW REFORMS?

There are two kinds of 2nd degree murder charges in Minnesota; one requires proof the at the defendant intended to kill and the other covers unintended murders where the defendant caused the unintended death during the commission of a felony. Minnesota chose the latter ((2) of Subdivision 2 below) which requires the government to prove that officer Chauvin intended to commit a felony assault on George Floyd and when he did so, his death occurred. The following is from Minnesota Statute §609.195 (2020).

609.195 MURDER IN THE SECOND DEGREE

Subdivision 1.  Intentional murder; drive-by shootings. — Whoever does either of the following is guilty of murder in the second degree and may be sentenced to imprisonment for not more than 40 years:(1) causes the death of a human being with intent to effect the death of that person or another, but without premeditation; or

(2) causes the death of a human being while committing or attempting to commit a drive-by shooting in violation of section 609.66, subdivision 1e, under circumstances other than those described in section 609.185, paragraph (a), clause (3).

Subd. 2.  Unintentional murders. — Whoever does either of the following is guilty of unintentional murder in the second degree and may be sentenced to imprisonment for not more than 40 years:

(1) causes the death of a human being, without intent to effect the death of any person, while committing or attempting to commit a felony offense other than criminal sexual conduct in the first or second degree with force or violence or a drive-by shooting; or

(2) causes the death of a human being without intent to effect the death of any person, while intentionally inflicting or attempting to inflict bodily harm upon the victim, when the perpetrator is restrained under an order for protection and the victim is a person designated to receive protection under the order. As used in this clause, “order for protection” includes an order for protection issued under chapter 518B; a harassment restraining order issued under section 609.748; a court order setting conditions of pretrial release or conditions of a criminal sentence or juvenile court disposition; a restraining order issued in a marriage dissolution action; and any order issued by a court of another state or of the United States that is similar to any of these orders.

The other officers are charged with aiding and abetting Chauvin in the commission of a felony - the felony here is assault. Aiding and abetting - a "person is criminally liable for a crime committed by another if the person intentionally aids, advises, hires, counsels, or conspires with or otherwise procures the other to commit the crime." 

The complaints detail how none of the three officers took action to assist Floyd, change his position or reduce the force Chauvin was using. In fact, the complaint alleges that none of the three officers moved from their positions as Floyd begged for help.  

The criminal complaint states that the first felony count of aiding and abetting second-degree murder is punishable by up to 40 years in prison, while the second count of aiding and abetting second-degree manslaughter is punishable by up to 10 years in prison and/or a fine of up to $20,000. [MORE]

The Jurist reported that Ellison also warned that “In order to be thorough [to let the public cool off], this is going to take months [because the videos are sooo long]. It is better to make sure that we have a solid case, fully investigated, researched, before we go to trial, than to rush it. It will take a while, I can’t set a deadline on that.” In response to questions on past prosecutions of police officers in the US, Ellison acknowledged that no one in the US has successfully prosecuted a police officer for second-degree murder and that only one officer in Minnesota has been convicted of killing a civilian while serving in that role.

Ellison also acknowledged the protests throughout the country and stated that he believes that “Our country has under-prosecuted these matters, in Minnesota and throughout the country,” but also that “We can’t control the past—all we can do is take the case we have in front of us right now, and do our best to bring justice to the situation.”

Drew Evans, the superintendent of Minnesota’s Bureau of Criminal Apprehension, also added that the authorities are in the process of taking the other three police officers involved into custody. Those officers have all now been charged with aiding and abetting second-degree murder as well as aiding and abetting second-degree manslaughter. He stated that “One is in custody, the other two we are in the process of taking into custody and expect them to this afternoon.”

Meanwhile, the protests against systemic racism in law enforcement and the killing of George Floyd have continued for the eighth day across the US. Protests have predominantly been peaceful. Most cities have continued to have few reported incidents of violence or looting. However, some locations have continued to see incidents of violent riots and intense clashes with police forces. Many cities have instituted curfews that remain in place, but many have been openly defied.

All racists are unconscious whenever the phenomenon of "race" or skin color is present in their mind. Rajineesh explains, 

If you live in such a way that the eyes see and yet do not see; that the ears hear and yet do not hear; that the heart throbs and yet remains like a rock, you are alive in the physiological sense of the word, medically you are alive – but not existentially. What happens? – all your understanding is like misunderstanding. It would have been better if you had had no eyes. At least you would not have forgotten the fact that you are blind; at least you would have known that you cannot see; at least there would have been no possibility of misunderstanding.

It would have been better if you had had no ears. It would have been better if you were not alive, but really dead. At least, there would have been some reality in it. A really dead person is at least really dead, but an “unreally” alive person is not really alive, he is in a limbo, neither alive nor dead. He drags, he doesn’t exist and he has no inner dimension. When racist cops are in the presence of color, especially Black men, they are unable to see things as they really are. Their eyes seem to be filled with thoughts and all sorts of idiotic programming about non-whites must be running through their mind. This reactionary state renders them robotically stupid, corpse like and uncivilized. Anything a cop does in this sleeping state will be dangerous b/c he has a belt full of weapons, the power of the state and is licensed to kill. In other contexts, things racists do or say in their relations with you will also probably be stupid or highly controlled or scripted with hate boiling just below the surface; know this while they are in your presence. 

Suffering from the disease of constant comparison racists and their make believe beliefs, [imagining themselves to be a part of a hierarchy wherein persons unable to produce color & lacking melanin are supreme; imagining themselves to be higher than what they imagine you to be] are in a state of non-reality, a play world. Dr. Blynd explained, "A divided mind, with the an unconscious and a conscious one, can never apperceive things as they are. Truth is adulterated with falsehood in the same proportion to which one is unconscious." Rajioneesh explained, "A mind that is filled with belief is a mind which can project anything according to the belief. When you see things always remember this." 

The Psychopathic Racial Personality. According to Dr. Blynd, race is "a totally artificial theologically-driven, biologically-based, and scientifically-invalid "European" ideology of human genetic evolution and classification coinciding with the emergence of colonialism and the rise of the transatlantic slave trade."

Welsing stated, ‘Having little biological validity, the term "race" is better translated to mean organization. The sole purpose of such organization is to maintain white domination and world control of non-whites, who have been frictionalized into made up classifications of people by elite racists.’ [MORE] The only purpose of race is to practice racism. Albert Einstein, the Nobel prize winning scientist stated: "The separation of the races is not a disease of colored people. It is a disease of white people. I do not intend to be quiet about it." Doc Blynd further states, Racism is a "virus in the mind. A racist is a psychopath at war with his own being." [MORE]

Dr. Bobby Wright explains that by and large, white people treat each other humanely. When white cops brutalize other white people, white prosecutors, white judges, white jurors and the white media usually ensure that the cop is held accountable; no need for suspenseful court drama or protests. But in their relations with non-white people, racists simply function as psychopaths. Wright states:

Behavioral scientists generally agree that the outstanding characteristics of the psychopathic personality are the almost complete absence of ethical or moral development and an almost total disregard for appropriate patterns of behavior. This characteristic has led to a misunderstanding of the psychopath as someone who does not know the difference between right and wrong. This belief is not true; psychopaths simply ignore the concept of right and wrong. By ignoring this trait in the White race (the lack of ethical and moral development) Blacks have made and are still making a tragic mistake in basing the worldwide Black liberation movement on moral suasion. In a system of white supremacy/racism it is logical to assume that most white people are racist. Neely Fuller explains, "most white people hate Black people. The reason that most white people hate Black people is because whites are not Black people. If you know this about white people, you need know little else. If you can remember, try to observe the thoughts in your mind. Because if you believe in their fairy tale - that you are somehow an inferior being worthy of their domination - then you are playing a servant role in a relationship with them & you are also probably going crazy,  self oppressive. Contrary to government and media spinfidels’ claim that the protesters are ‘outsiders,’ ‘agitators’ and or anarchists [claims made for the sake of their own positive self-perception] the protesters are persons with “legitimate outrage at psychological, social, judicial, and economic oppression and demands of self determination" and ‘people left with no other means to resist white supremacy.’

Here, the Government exacerbated an already fucked up situation in the system of miserabilia by cooping people up in their homes for months while simultaneously preventing them from making a living without any just compensation in violation of their so-called constitutional rights under the Takings Clause. Yet we are still required to pay rent, utilities, food, medicine and other material bills either now or in a lump sum at the end of the stay in place orders. Poor & working class people have no way to pay said bills and imminently face eviction, utility shut-offs, car repossessions, food insecurity & homelessness when governments lift their shut down orders. The state and federal governments have given the working poor the middle finger. As such, people are under mad stress and are motivated primarily by anxiety and real anger. Folks were already tired of the compounded bullshit when the latest round of “justifiable homicides” by genocidal racists and fuckery from unaccountable cops occurred within yurugu’s free range prison.

Unfortunately though, as explained by undeceiver Larken Rose “protests for the most part, do little more than reinforce authoritarianism. Marches, protests, and so on, are designed to send a message to the masters, the goal being to convince the masters to change their evil ways. But that message still implies that it is up to the masters what the people may do, which becomes a self-fulfilling prophecy: when the people feel beholden to an “authority,” they are beholden to an “authority.” Those in “government” derive all of their power from the fact that their subjects imagine them to have power.“

The same characteristics which when they are endemic to the White community and are perceived as threatening to its equilibrium, integrity and functionality, are externalized onto the Black community through projection. Consequently, the threats that come from inside the White community are perceived as coming from the outside Black community and are therefore perceived as generated by the latter. Thus the White community makes it appear that it is threatened by a menacing Black community; an evil, criminal, Black community which jeopardizes its existence: not the evil criminal inclinations it contains within its own bosom. By compulsively defending itself against the projected "threat" the Black community represents, the White community defends itself against its own self-generated, but self-denied, threats. The White community thereby becomes blind to its own negative characteristics and the positive characteristics of its scapegoat, the Black community.

Through projection the White community seeks to transform its evil, criminal, genocidal characteristics and intentions into good, law-abiding characteristics and intentions. Thus its evil becomes good. Once it projectively criminalizes the Black community it feels free to treat it criminally. Thus, to defend its own positive self-perception against knowledge  of its own criminality, the White community must falsely accuse the Black community of criminality. For the sake of its own positive self-perception, the White community needs to perceive the Black community as criminal, whether or not such is the case.

When the projecting party or projectionist has superior influential advantages, as in the case of the White community relative to the Black community, projection becomes introjection, an act of creation, of transforming and conditioning reality. Introjection refers to the process by which the individual incorpo­rates  and accepts the prohibitions, values, attitudes,  and commands of others as his own even when their acceptance and incorporation may work against his objective interests. In addition to its usual meaning, introjection as used herein refers to the process by which a more powerful party through various means, "forces" a weaker party to accept or behave in accordance with his projected values, attitudes and such. When the projectionist is the more powerful, the chief reinforcer and punisher, his projection becomes not only an instrument of ego-defensive self-deception, but also an instrument for provoking self-deception in the other, the target of his projections. Introjective projection is accomplished when through its manipulative use of reward and punishment, control of informa­tion, definition of reality, etc., the White community inculcates in the collective personality of that community, a complementary and supportive set of values, norms, and patterns of behavior. From [HERE] Mayor Bill de Blasio on Sunday blamed an organized group of anarchists for inciting violence and vandalism amid protests over the killing of George Floyd, but conceded some were from the city and the neighborhoods where demonstrations were happening — a shift from his message Saturday night. 

“Some come from outside the city. Some are from inside the city,” he said. “Some are from the neighborhoods where the protests take place, some are not. But what we do know is there is an explicit agenda of violence and it does not conform with the history of this city in which we have always honored non-violent protests.”

Only hours before, on Saturday night, the mayor insisted the threat of violence was coming from “out of town” demonstrators, many of whom are “not from communities of color” and have a “warped ideology” that leads them to “harming working people who are police officers.”

De Blasio, who first came to office with a promise of police reform, has ardently defended the NYPD during the recent protests and insisted officers were exercising great restraint in the face of threats from demonstrators bent on attacking cops. He’s faced fierce backlash from criminal justice advocates and members of his own party.

“@NYCMayor your comments tonight were unacceptable,” Rep. Alexandria Ocasio-Cortez tweeted early Sunday morning. “Defending and making excuses for NYPD running SUVs into crowds was wrong. Make it right. De-escalate.” 

Police officers drove through a barricade into throngs of protesters in Brooklyn Saturday evening. Video of the incident, which quickly went viral, shows demonstrators throwing cones, garbage bags and water bottles at the NYPD vehicles before they plowed into the crowds.

The mayor insisted again Sunday the officers were reacting to a dangerous situation caused by threats of violence.

“We’re going to fully investigate that incident,” the mayor said Sunday. “I don’t ever want to see a police officer do that. ... But I also know that it was an extremely dangerous situation and the one thing [police] couldn’t do was stay there.”

“There are protests, and there are mobs,” NYPD Commissioner Dermot Shea added later in the conference. “A protest does not involve surrounding and ambushing a marked police car.”

New York City Public Advocate Jumaane Williams, speaking in a separate press conference that morning, criticized the mayor’s earlier remarks to the incident as “a terrible response.”

Alexandra Petri of WP writes, “The autopsy revealed no physical findings that support a diagnosis of traumatic asphyxia or strangulation. Mr. Floyd had underlying health conditions including coronary artery disease and hypertensive heart disease. The combined effects of Mr. Floyd being restrained by the police, his underlying health conditions and any potential intoxicants in his system likely contributed to his death.”

I see. Ah, yes. Suddenly, as if by magic, through no fault of anyone’s, these underlying health conditions(!) and potential intoxicants — intoxicants that had not even made up their minds whether to exist yet — decided to strike. And how convenient that they chose the moment when Derek Chauvin placed his knee on George Floyd’s neck.

A miracle! A true thermodynamic miracle for the police officer, if something so unfortunate can be called a miracle. Once again we see it proved, against all odds: Police officers do not kill black people. They just have the constant, perplexing ill luck to be “involved” at precisely the wrong moment. Through their singular misfortune, it is always at the moment that their knee is descending on a human neck, or their bullet is flying toward a man, or they have him in a chokehold, when this human being’s own system decides to turn against him. It is a horrible curse. It is a dire magic, the same thing that turns whatever this person is holding into a weapon, then turns it right back into a phone or a toy or a bag of candy the second afterward.

A wonder this does not appear on other autopsy reports (“It was not the robber who killed him; it was the combination of his underlying health conditions and the robber’s knife to the ribs.”). Or perhaps it is not so much a wonder, when you consider the ugly underlying condition of white supremacy that has been strangling this country for centuries. This miracle of obfuscation only occurs for certain acts: those of racial violence committed with impunity. Immediately, miraculously, culpability vanishes, and the officer “involved” is guilty only of terribly bad timing.

Someone who did not know any better might think that if no officer had been involved, these conditions would not have been sufficient to bring about death at all, and that “the combined effects of underlying health conditions and being restrained by the police” is doing a tremendous amount of work. Why, the combined effects of underlying health conditions and fatal force could kill almost anyone. Someone who did not know any better might think this was murder.

When Does a Prosecutor Have this Much Objective, Non-testimonial Evidence of Murder? From [HERE] During a press conference Thursday evening, state and federal law enforcement officials said their agencies plan to thoroughly investigate the death of George Floyd. 

At the press conference, U.S. Attorney Erica MacDonald opened by saying, "We thought we would have another development I could tell you about, unfortunately, we don't at this point."

However, no charges for any crime have been filed against any of the cops involved in the violent death of Floyd.

Above, Hennepin County Attorney Mike Freeman hasn’t found enough facts yet to charge any cops of any crime they committed.

In Minnesota prosecutors must seek an indictment from a grand jury for offenses for charges such as 1st degree murder that are punishable by life imprisonment. However, prosecutors may directly charge for all other offenses such as 2nd or 3rd degree murder or 1st or 2nd degree assault (use of knee as weapon) or misdemeanor assault.

In the George Floyd matter, the white county and federal prosecutors have the discretionary authority to charge the white cop involved with 2nd or 3rd degree murder, manslaughter or 1st degree assault or 2nd degree assault (use of knee) or alternatively they could charge him with misdemeanor 4th or 5th degree assault. The asian cop involved could be charged as an assessor or accomplice. Once charged the prosecutors then has the discretionary authority to upgrade any of the above charges. Thus far, racist suspect county and federal prosecutors have not used their discretion to do so.

609.19 MURDER IN THE SECOND DEGREE

Subdivision 1.  Intentional murder; drive-by shootings. — Whoever does either of the following is guilty of murder in the second degree and may be sentenced to imprisonment for not more than 40 years:(1) causes the death of a human being with intent to effect the death of that person or another, but without premeditation; or(2) causes the death of a human being while committing or attempting to commit a drive-by shooting in violation of section 609.66, subdivision 1e, under circumstances other than those described in section 609.185, paragraph (a), clause (3).

609.195 MURDER IN THE THIRD DEGREE

(a) Whoever, without intent to effect the death of any person, causes the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life, is guilty of murder in the third degree and may be sentenced to imprisonment for not more than 25 years.

609.20 MANSLAUGHTER IN THE FIRST DEGREE

Whoever does any of the following is guilty of manslaughter in the first degree and may be sentenced to imprisonment for not more than 15 years or to payment of a fine of not more than $ 30,000, or both:

(1) intentionally causes the death of another person in the heat of passion provoked by such words or acts of another as would provoke a person of ordinary self-control under like circumstances, provided that the crying of a child does not constitute provocation;

(2) violates section 609.224 and causes the death of another or causes the death of another in committing or attempting to commit a misdemeanor or gross misdemeanor offense with such force and violence that death of or great bodily harm to any person was reasonably foreseeable, and murder in the first or second degree was not committed thereby;

609.205 MANSLAUGHTER IN THE SECOND DEGREE

A person who causes the death of another by any of the following means is guilty of manslaughter in the second degree and may be sentenced to imprisonment for not more than ten years or to payment of a fine of not more than $ 20,000, or both:

(1) by the person’s culpable negligence whereby the person creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm to another;

609.221 ASSAULT IN THE FIRST DEGREE

Subdivision 1.  Great bodily harm. — Whoever assaults another and inflicts great bodily harm may be sentenced to imprisonment for not more than 20 years or to payment of a fine of not more than $ 30,000, or both.

609.222 ASSAULT IN THE SECOND DEGREE

Subdivision 1.  Dangerous weapon. — Whoever assaults another with a dangerous weapon may be sentenced to imprisonment for not more than seven years or to payment of a fine of not more than $ 14,000, or both.

Subd. 2.  Dangerous weapon; substantial bodily harm. — Whoever assaults another with a dangerous weapon and inflicts substantial bodily harm may be sentenced to imprisonment for not more than ten years or to payment of a fine of not more than $ 20,000, or both.

Subd. 4.  Assaults motivated by bias. 

(a) Whoever assaults another because of the victim’s or another’s actual or perceived race, color, religion, sex, sexual orientation, disability as defined in section 363A.03, age, or national origin may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $ 3,000, or both.

609.2231 ASSAULT IN THE FOURTH DEGREE

Subd. 4.  Assaults motivated by bias. 

(a) Whoever assaults another because of the victim’s or another’s actual or perceived race, color, religion, sex, sexual orientation, disability as defined in section 363A.03, age, or national origin may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $ 3,000, or both.

609.224 ASSAULT IN THE FIFTH DEGREE

Subdivision 1.  Misdemeanor. — Whoever does any of the following commits an assault and is guilty of a misdemeanor:(1) commits an act with intent to cause fear in another of immediate bodily harm or death; or(2) intentionally inflicts or attempts to inflict bodily harm upon another.

Subd. 2.  Gross misdemeanor. (a) Whoever violates the provisions of subdivision 1 against the same victim within ten years of a previous qualified domestic violence-related offense conviction or adjudication of delinquency is guilty of a gross misdemeanor and may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $ 3,000, or both.(b) Whoever violates the provisions of subdivision 1 within three years of a previous qualified domestic violence-related offense conviction or adjudication of delinquency is guilty of a gross misdemeanor and may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $ 3,000, or both.
