Breaking w/o Entering? Video Shows an Alleged White Cop Wearing a Gas Mask & Costume Initiating the Looting in Minneapolis by Smashing the Windows of Auto Zone and then Calmly Walking Away

According to FTP, “several videos of a highly suspicious [white] man wearing a gas mask and carrying a hammer, paint an ominous picture of potential agent provocateurs stoking the rioting among the protesters.

Throughout the day, most of the protests in Minneapolis were peaceful with the exception of protesters directing their anger and property destruction toward the police department who refused to immediately charge George Floyd’s killers. However, as was widely reported, the Autozone near the department was one of the first places to be looted and set on fire.

Now, we have the video of the first person to instigate the destruction — and he was definitely not part of the George Floyd protests.

Brad Svenson (@SvensonBrad on pscp.tv) was streaming live Wednesday night. As he filmed the protests, he took no interest in the Autozone directly behind him as all the protesters were peacefully chanting at the officers in front of them.“

All of that quickly changed, however, when we hear a loud pop, followed by the sound of breaking glass. When Svenson panned his camera around, we see a shady white guy, dressed in all black, holding an umbrella, a hammer, and a gas mask, shattering the windows out of the Autozone like he was getting paid to do it.

The black umbrella is a symbol of the protests in Hong Kong. Protesters used umbrellas as a tool for passive resistance to the police’s use of pepper spray to disperse the crowd during the occupation of the city over the 2014 elections.

Illustrating just how reluctant the protesters were to begin rioting and looting, they yelled at the shady man in black and confronted him as he began smashing windows.

“Are you a cop?!” several of the protesters yell.

As the man attempts to escape without being tackled or stopped by folks who did not want the rioting and looting to start, the man becomes confrontational and challenges a Black man pursuing him to a fight. The Black man, says ‘Oh you wanna go’ and then turns give somebody his blunt - but the white man quickly flees from the confrontation with the black man in pursuit. The provocateur tries to swat the camera from the person filming him.

“Get the f**k away from me,” the agent provocateur says as he flees behind the Autozone. He is chased about 100 feet away before the video cuts out.

It is pretty clear from the video that the protesters — at least before the provocateur smashed out windows — wanted nothing to do with looting and destroying local businesses. However, after he smashed the windows of Autozone, it would set off a chain reaction, leading to a handful of others parting from the peaceful protests and begin looting.

Many have taken to social media to allege that he is a cop, with some claiming he fled into the police station.

Despite people on social media claiming the white man in the mask is Pederson, Heavy.com spoke to the St. Paul PD who claimed it was not him. In a statement sent to Heavy, Steve Linders, public information officer for the Saint Paul Police Department, wrote that the post accusing Pederson was a “false social media post.” The man isn’t Pederson, he stated (although he didn’t use Pederson’s name, Heavy asked about that.)

From [HERE] A Minneapolis police force has released bodycam footage showing the scene at George Floyd’s arrest amid a second night of protests over the black man’s death. 

The Minneapolis Park Police (MPP) video, which was made public on Wednesday night, shows an officer monitoring a vehicle opposite to where Mr Floyd was arrested and pinned to the ground before his death on Monday. 

The MPP officer wearing the bodycam also appeared to reassure two passengers from Mr Floyd’s car that an ambulance would arrive at the scene, and told them to “stay put”.

Minneapolis Park Police maintain that despite having one patrol car at the scene, the officer with the bodycam was not involved with the actions that led to Mr Floyd’s death. 

“Based on a review of the body worn camera footage, which is being released to demonstrate the vantage point of the Park Police officer, the Park Police officer was not in a location to witness or intervene in the MPD incident,” the MPP said in a statement. 

The park police added that the officer was around 118 feet (36 metres) from Mr Floyd as he was arrested outside Cup Foods on Chicago Avenue, on Monday.

It comes as two more videos appeared to show Mr Floyd being pulled from his car and handcuffed without resisting arrest. 

An MPD statement had said Mr Floyd was “resistant” before a white police officer knelt on his neck until he could not breath.

The new park police video did not shed more light on the incident which has led to demonstrations against police brutality against black Americans. [MORE]

As federal and local officials said they continue to investigate, Minnesota Gov. Tim Walz (D) activated the state’s National Guard to respond to upheaval, including violent clashes and razed buildings, in the Twin Cities area. 

Viral video captured a white cop on Monday torturing Floyd to death by pressing his knee into his neck while he was already subdued and handcuffed. Floyd begged for his life, the officer seemed to enjoy it while an Asian cop stood nearby to obscure the view of onlookers and cameras.

Here are some significant developments:

• Local and federal officials have yet to announce any charges against the officers involved but emphasized at a news conference Thursday evening that they are making the inquiry into Floyd’s death a top priority.

• The House Judiciary Committee on Thursday called on the Justice Department to investigate whether the death of George Floyd was part of a “pattern or practice of unconstitutional conduct” by the Minneapolis Police Department.

• The mayor of St. Paul asked people to stay home amid a “rapidly devolving” situation in the capital, as police there said they were trying to disperse groups damaging property and looting.

• Officers used tear gas on protesters gathered outside a St. Paul Target where police have struggled to maintain order throughout the day and said they have been assaulted.

• Floyd’s family will seek an independent autopsy of his body because it does not trust Minneapolis city officials, an attorney for the family said Thursday on CNN.

“We’re the black sheep put in the corner. The city, the government, they have forgotten us.” The NYT reports “One of the worst health crises in a century has exploded across New York City, and it has inflicted the worst toll on the Bronx, the city’s poorest borough.

It has spread building by building in neighborhoods like Morris Heights that have been unable to fight back, reflecting a legacy of institutionalized racism, poverty, cramped housing and chronic health problems that have put their residents at higher risk of getting sick and dying.

The Bronx has the highest rates of coronavirus cases, hospitalizations and deaths in the city, while the most well-off borough, Manhattan, has the lowest rates.

In just months, the coronavirus has threatened to wipe out more than a decade of efforts to rebuild the Bronx with new development and businesses and has made life even more precarious for those already struggling to survive, including low-paid essential workers without health insurance, paid sick time or unions to back them.

The economic fallout has shuttered stores, restaurants and businesses across the borough and left thousands out of work, struggling to pay rent and buy food. As in the other boroughs, unemployment claims have surged in the Bronx — by mid-May they had skyrocketed 2,000 percent from a year ago. One Bronx economic development official warned that up to half the borough’s restaurants may never reopen.

The crisis has stirred frustration and resentment among Bronx residents angered that, once again, they are the ones paying the highest price. The Bronx has long struggled to attract attention and resources. During the economic boom of the past decade, it lagged behind the rest of the city in many indicators, including poverty and unemployment.

“This will happen again. This is not the last pandemic,” said Ruben Diaz Jr., the Bronx borough president, who counts at least three deaths in his own apartment complex in the Soundview neighborhood. “How do we remedy institutionalized neglect in communities like the Bronx so in the future we have a fighting chance?”

The coronavirus has been particularly deadly in the Bronx because race and income are key factors in who survives and who does not. At least 4,400 confirmed and probable Covid-19 deaths in the Bronx have been reported as of May 26.

Across the city, neighborhoods with large numbers of black, Latino or poor residents have the highest death rates. In the Bronx, about 90 percent of the borough’s 1.4 million residents are people of color, the highest concentration in the city, according to census data.

Many public health experts and Bronx officials say more should have been done to protect vulnerable communities. City and state leaders, they say, should have aggressively conducted testing to slow the spread of the virus, deployed more services and resources and focused on overlooked front-line workers who have kept stores open and the city running.

“We as a state and as a city could have done better,” said State Assemblyman Victor M. Pichardo, whose parents were both sickened by the virus. “We’re sort of picking up the pieces now.”

Mr. Pichardo said it was not until May — two months after the pandemic shut down the city — that he received more than 4,000 masks from the mayor’s office, and 300 bottles of hand sanitizer from the governor’s office, for his district, which includes Morris Heights.

Adults in the Bronx have the highest rates in the city of asthma, diabetes and high blood pressure, all of which can lead to severe complications for people who are infected with the coronavirus. Roughly one in three Bronx adults is obese — another factor that can make the virus worse — and lack of ready access to healthy foods makes it difficult for people to change their diets.

Of those Bronx residents who died from Covid-19, 90 percent had at least one such underlying condition.

The Bronx ranked last among New York State’s 62 counties in an annual survey of health indicators. And life expectancy in the Bronx is about five years lower than in Manhattan.

“What Covid-19 really shines a very harsh light on are the historical inequities in socioeconomic status and structural racism that are really driving disparities in health outcomes,” said Nadia S. Islam, an associate professor of population health at New York University’s Grossman School of Medicine.

The city’s northern borough once drew well-to-do families to its stretches of parkland and Art Deco apartment buildings. But in the 1970s, arson fires, rampant crime and poverty drove out residents, and turned the borough into a national symbol of urban decay.

Today, the Bronx is home to the nation’s poorest congressional district. Median household income is $38,000, compared with $82,000 in Manhattan and about $61,000 citywide.

For Margarita Brown, 48, a pharmacist technician, getting ready for work is “like preparing for war.” She puts on a mask and gloves before getting into elevators “packed like sardines.” She has to go around crowds in the lobby before riding a bus to a pharmacy on the Upper West Side of Manhattan.

NYT states, “His binoculars around his neck, Christian Cooper, an avid birder, was back in his happy place on Wednesday: Central Park during migration season. He was trying to focus on the olive-sided flycatchers and red-bellied woodpeckers — not on what had happened there two days earlier.

That was when Mr. Cooper, who is black, asked a white woman to put her dog on a leash. When she did not, he began filming. In response, the woman said she would tell the police that “an African-American man is threatening my life” before dialing 911.

On Tuesday, the video went viral on Twitter and garnered over 40 million views, setting off a painful discourse about the history of dangerous false accusations against black people made to police.

The birds were a welcome distraction from thinking about [dealing with the reality of racism white supremacy] what had happened next: By that day’s end, the white woman, Amy Cooper (no relation) had surrendered her dog and had been fired from her high-level finance job. As he wandered the park’s North Woods on Wednesday shortly after dawn, he said he felt exhausted, exposed and profoundly conflicted, particularly about Ms. Cooper’s fate. The NYT reports, “The incident appears to have begun as one of those banal and brusque dust-ups between two New Yorkers. A black man, an avid birder, asked a white woman to leash her dog in Central Park, as the rules required. She refused.

Then the encounter, which was recorded on video, took an ugly turn.

As the man, Christian Cooper, filmed on his phone, the woman, clutching her thrashing dog, called the police, her voice rising in hysteria.

“I’m going to tell them there’s an African-American man threatening my life,” she said to him while dialing, then repeated to the operator, twice, “African-American.”

The video, posted to Twitter on Memorial Day by Mr. Cooper’s sister, has been viewed more than 30 million times, touching off intense discussions about the history of false accusations made to the police against black people, sometimes putting their lives in danger.

Within 24 hours, the woman, identified as Amy Cooper (no relation to Mr. Cooper), had given up her dog, publicly apologized and been fired from her job. Mr. Cooper expressed regret for the extent of the retribution.”

The initial psychological defense maneuver was the repression of the initial painful awareness of inadequacy. This primary ego defense was reinforced by a host of other defense mechanisms.

One of the most important of these defense mechanisms was reaction formation, a response that converts (at the psychological level) something desired and envied but wholly unattainable, into something discredited and despised. The whites, desiring to have skin color but unable to attain it, claimed (consciously or unconsciously) that skin color was disgusting to them, and began attributing negative qualities to color - especially to blackness. Interestingly, the term "non-white" is a double negative result­ing in a positive statement. This is perhaps a Freudian slip, wherein the use of language ultimately reveals the primary psychological dynamic. Genocidal White Cop Appears to Enjoy Torturing a Handcuffed Black Man to Death by Kneeling on His Neck as He Begs for His Life: Murdered on Behalf of the System of White Supremacy & Minneapolis

From [HERE] Shocking video has emerged showing a white Minneapolis police officer pinning a black man to the ground by his neck with his knee, moments before the suspect loses consciousness and dies. 

The disturbing footage was taken by a bystander in south Minneapolis on Monday evening and has now sparked an FBI investigation into the man's death. 

The Minneapolis Police Department confirmed the man died in a statement later that night, after the arresting officers responded to a 'forgery in progress.'  

Police found the man, believed to be in his 40s, matching the suspect's description in his car. 

According to police, who lie all the time, He was ordered to step from his car. After he got out, he physically resisted officers,' police spokesman John Elder claimed in a statement. 

'Officers were able to get the suspect into handcuffs and noted he appeared to be suffering medical distress.'

The man, who was not identified, was taken by ambulance to Hennepin County Medical Center where he died a short time later, police said.

But in the footage, the arresting police officer was seen pinning the man to the ground for more than six minutes as he pleaded with officers for his life. 

'Please. Please, I can't breathe,' the man, who is shirtless, is heard begging cops. 'My stomach hurts. My neck hurts. Everything hurts.' 

The officer continues to kneel on the man's neck for several minutes while he moans in pain. The police are not waiting for anything - the arrest was complete, the Black man was clearly not resisting, in fact the officer had both hands in his pockets as he held him down. Yet the torture continued as the white officer appeared to enjoy the face sitting. Said white cop apparently suffers from the psychopathic racial personality disorder.

The video was shared on Facebook by bystander Darnella Frazier, and has drawn comparisons to the case of Eric Garner, a black man who was a killed in 2014 after New York City police officers put him in a lethal chokehold.

In Monday's video, multiple witnesses are heard arguing with the two arresting officers over their excessive use of force.

'Bro, you've got him down at least let him breathe, man,' a male onlooker says.  

'He's not even resisting arrest ... he's human, bro.'

'This ain't about drugs, bro! He's human,' the bystander says.

'You're enjoying it. Look at you. Your body language, you bum. You know that's bogus right now,' he adds. 

About four minutes into the video, the man appears to begin to lose consciousness before becoming unresponsive. 

An ambulance then arrives and police officers move the man's limp body onto a stretcher.

President Trump calls them a “super-duper missile,” though they’re better known as hypersonic weapons.

For decades the United States has searched for ways to get ultrafast flight right, but it has done so in fits and starts. Now, with China and Russia arguably ahead in this chase, the Trump administration is pouring billions of dollars a year into hypersonic offense and defense.

The Pentagon makes no bones about their purpose.

“Our ultimate goal is, simply, we want to dominate future battlefields,” Mark Lewis, the Pentagon’s director of defense research and engineering for modernization, told reporters in March.

Critics say that hypersonic weapons would add little to the United States’ ability to deter war. Some think they could ignite a new, destabilizing arms race.

Here is a look at hypersonic weapons.

Two things make these weapons special: speed and maneuverability. Speed brings surprise, and maneuverability creates elusiveness. Together, those qualities could mean trouble for missile defenses.

By generally agreed definition, a hypersonic weapon is one that flies faster than Mach 5, or five times the speed of sound: 3,836 miles per hour — a bit faster than 1 mile per second. Most American missiles, such as those launched from aircraft to hit other aircraft or ground targets, travel between Mach 1 and Mach 5.

Trump occasionally mentions his interest in hypersonic weapons, sometimes without using the term. In February he told governors visiting the White House: “We have the super-fast missiles — tremendous number of the super-fast. We call them ‘super-fast,’ where they’re four, five, six and even seven times faster than an ordinary missile. We need that because, again, Russia has some.”

And last Friday, Trump told reporters, “We have no choice, we have to do it, with the adversaries we have out there,” mentioning China and Russia. He added, “I call it the super-duper missile.” He said he “heard” it travels 17 times faster than any other U.S. missile. “It just got the go-ahead,” he added, although the Pentagon would not comment on that.

The Pentagon is pursuing two main types of hypersonic weapons. One, called a hypersonic glide vehicle, is launched from a rocket, then glides to a target, maneuvering at high speed to evade interception. The other is sometimes referred to as a hypersonic cruise missile. Capable of being launched from a fighter jet or bomber, it would be powered by a supersonic combustion ramjet, or scramjet, enabling the missile to fly and maneuver at lower altitudes.

On March 19, the Pentagon flight-tested a hypersonic glide vehicle at its Pacific Missile Range Facility in Kauai, Hawaii. It deemed the test a success and “a major milestone toward the department’s goal of fielding hypersonic warfighting capabilities in the early- to mid-2020s.”

Unlike Russia, the United States says it is not developing hypersonic weapons for use with a nuclear warhead. As a result, a U.S. hypersonic weapon will need to be more accurate, posing additional technical challenges.

As recently as 2017, the Pentagon was spending about $800 million on hypersonic weapon programs. That nearly doubled the next year, then rose to $2.4 billion a year later and hit $3.4 billion this year. The administration’s 2021 budget request, which has yet to be approved by Congress, requests $3.6 billion.

Although this is a priority for Pentagon spending, it could become limited by the budget pressures resulting from multitrillion-dollar federal spending to counter the coronavirus pandemic.

Top Pentagon officials say it’s about Russia and, even more so, China.

“By almost any metric that I can construct, China is certainly moving out ahead of us,” Lewis, the Pentagon research and engineering official, said Tuesday. “In large measure, that’s because we did their homework for them.”

Basic research in this field was published by the United States years ago, “and then we kind of took our foot off the gas,” although the Pentagon is now on a path to catch up and surpass China, he said.

China is pushing for hypersonic weapon breakthroughs. It has conducted a number of successful tests of the DF-17, a medium-range ballistic missile designed to launch hypersonic glide vehicles. According to a Congressional Research Service report in March, U.S. intelligence analysts assess that the DF-17 missile has a range of approximately 1,000 to 1,500 miles and could be deployed this year. Marcus Mosley, a 48-year-old Indiana resident, claims in a 12-count federal lawsuit filed last week that a white Lynwood police officer concocted a bogus story about him urinating on the side of Glenwood Dyer Road as a pretext to harass him despite his having committed no crime or unlawful act.

The May 17, 2019 incident, which was recorded by police body worn camera, occurred on the side of Glenwood Dyer Road at Torrence Avenue after Tambrini pulled up behind Mosley’s truck, which was parked on the side of the road.

Mosley’s attorney Victor Henderson said his client had stopped his truck on the side of the road so he could get out to organize its contents and confirm he had what he needed for his trip to an unspecified destination.

Tambrini told Mosley he wasn’t allowed to park on the side of the road or to urinate in public and asked for his identification, the video shows.

After Mosley denied that he’d urinated in public, Tambrini conducted what the suit calls a “sham field investigation” during which Mosley was subjected to “a willful and wanton display of outrageously inhuman cruelty.”

Tambrini first asked Mosley to take his finger and touch a “little puddle of water” beside his car that he claimed was urine, the video shows. After Mosley obliged, Tambrini replied, “Now lick it.”

“Who’s gonna lick dirt?” Mosley replied, visibly upset. “You think ‘cause I’m black I’m gonna sit here and touch some dirt, then lick it?”

Mosley then requested that the officer call a supervisor to the scene because he had a problem with how he was being treated.

When Tambrini told Mosley he was going to write him tickets for parking illegally and urinating in public, Mosley declined to provide him his name and information and repeatedly asked that a supervisor be dispatched to the scene, according to the video.

Eventually, Tambrini said he was going to have to arrest Mosley for obstructing identification and “needlessly escalated the situation by drawing, pointing, and shooting a Taser” at Mosley, according to the suit.

The video shows Mosley stumbling as he’s being stunned, repeatedly asking for a supervisor and saying he hadn’t done anything wrong. The officer can be heard commanding his K9, which had been waiting inside his vehicle, to attack Mosley.

“Please don’t have that dog bite me,” Mosley can be heard saying, as the dog attacks him and he’s taken to the ground.

Mosley was hospitalized with bites to his left arm and shoulder that punctured the skin and continues to suffer physical and emotional trauma from the attack, according to the suit.

He was subsequently charged with aggravated unlawful use of a weapon, resisting a peace officer and obstructing a peace officer, among other things, the suit claims.

The aggravated unlawful use of a weapon case, which the suit claims stems from a lawfully owned handgun found in Mosley’s truck, remains pending, according to court records. His attorney said the other charges were also still pending.

Mosley’s suit accuses Tambrini of excessive force, false arrest and battery, among other things, and charges another officer who arrived to the scene later with failing to intervene.

The father of three said in a statement this week that he was still in shock about what happened last May, but wanted to speak out “for the benefit of law-abiding citizens across this country.”

In Service & Protection of Sam’s Club White MO Cops Beat Up & Arrested a Black Man & His Grandmom who Demanded a Refund after Being Falsely Accused of Theft of a TV They Purchased

She was prone on the concrete floor of the Sam’s Club in Des Peres. Her only son, Derek, was next to her.

“They going to kill him,” she thought. “I gave up. This is the way Derek is going to go. They were beating him so bad.”

Gray, who is 68, made the allegations against the Des Peres police department in a video news conference Monday afternoon, after her attorneys, William Dailey of St. Louis and Andrew Stroth of Chicago, filed a civil rights lawsuit against Des Peres and four of its police officers on her behalf. The lawsuit accuses the city and its officers of assault and battery, false imprisonment and malicious and false prosecution over charges brought against Marvia Gray in April.

The Grays are black. The police officers involved appear to be all white.

The lawsuit stems from an incident on March 23, when Gray and her 43-year-old son bought a 65-inch, flat-screen television at Sam’s Club on Manchester Road. When the Grays couldn’t fit the TV in their SUV, they took it back into the store and asked that it be placed on a pallet near the front of the store, where Derek Gray could later retrieve it.

When Derek Gray returned to get the television, the lawsuit says, a store employee didn’t believe he had purchased it, and he was forced to come inside to customer service to show the receipt. Another employee of the store let fellow employees know the television had been properly purchased, the lawsuit alleges. Derek Gray put the television in his vehicle, but when he got it home told his mother that they first accused him of stealing it.

Marvia Gray, who lives in Creve Coeur and had been shopping at the store for 10 years, became incensed, the lawsuit says, so she and her son drove back to the store to return the items.

At that point, the lawsuit alleges:

“While the Grays were at the Store attempting to get a refund, Officer (Michael) Clayborne, Officer (Bradley) Summers, Officer (Ryan) Ringeisen, and Officer (Bill) Maull, without cause or adequate provocation and in the presence of countless witnesses, violently and physically seized Marvia Gray and Derek Gray, throwing them to the floor, beating them, handcuffing them, then arresting them. These actions are captured on closed-circuit video taken by the surveillance cameras in the Store and cell phones of onlookers.”

A cellphone video provided by Stroth to reporters shows the two Grays already on the ground, struggling while police officers cuff their hands behind their backs and pin them down to the ground.

Marvia Gray can be heard screaming: “Leave me alone, please … What are you doing … Please let me go.”

Derek Gray’s head appears to be bleeding in the video.

At the time of the incident, the Des Peres police department issued a statement on its Facebook page, responding to social media discussion of the event.

“Upon our arrival, officers were notified … that the items were in fact stolen,” the statement said. “A family member who began to grab and pull at the officers during the initial contact was also taken into custody and charged with interfering and resisting arrest.”

Marvia Gray faces a charge of resisting arrest and interfering with police. There are no state charges filed against Derek Gray.

From [HERE] Police attempted to use a Taser on Ahmaud Arbery, the slain Georgia jogger, after questioning why he was sitting alone in his car in a park one morning in November 2017, according to records and a police video obtained by the Guardian.

The video, obtained through a public records request, comes to light as law enforcement in the area faces scrutiny after Arbery was shot dead by two white men while jogging in February. Police did not arrest Gregory and Travis McMichael, who chased down and killed the unarmed Arbery, and a prosecutor assigned to the case wrote a lengthy memo explaining why the killing was legally justified.

That prosecutor, George Barnhill, eventually recused himself, noting his son had worked with Gregory McMichael in the district attorney’s office and they had worked on a previous case Arbery was involved in.

In the video an officer patrolling the area suspected Arbery of using marijuana, saying he was in a park known for drug activity.

Arbery, dressed in a green hat, winter coat and athletic pants, said he didn’t have drugs and refused to let the officer search his car. He told the officer he was relaxing by rapping in his car over instrumental beats and had the day off from work at Blue Beacon Truck Wash.

The incident, previously described by the Atlanta Journal-Constitution, escalated when Arbery began to question why the officer, Michael Kanago, was hassling him. Kanago claimed he began to feel threatened by Arbery, later writing in his report that “veins were popping from [Arbery’s] chest, which made me feel that he was becoming enraged and may turn physically violent towards me”. Kanago requested help from a second officer.

“You’re bothering me for nothing,” Arbery said to Kanago, according to body camera footage. After Kanago told him he was looking for criminal activity, Arbery said “criminal activity? I’m in a fucking park. I work.”

The second officer, David Haney, arrived minutes later and screamed at Arbery to get his hands out of his pockets, which Arbery did.

Haney then attempted to tase Arbery, but his Taser malfunctioned, according to Kanago’s report. Arbery continued to comply with instructions from the two officers to get on the ground. Kanago had already searched Arbery for weapons before Haney arrived, and deduced he was unarmed.

“I get one day off a week…I’m up early in the morning trying to chill,” Arbery told the officers as he sat on the ground. “I’m just so aggravated because I work hard, six days a week.” [MORE]

Are Shut-Down Orders "a Taking" of Your Labor in Violation of the "Takings Clause" for which the State Must Pay Just Compensation? The Answer is Yes if You Believe Constitutional Rights Actually Exist

From [HERE] Governors across the country have issued executive orders mandating the closure of businesses they deem non-essential in an effort to slow the spread of COVID-19. Slowing the spread of COVID-19, in turn, benefits all the state’s residents. Thus, the owner of the closed business is made to sacrifice the use of his or her property for the good of the general public. Has the state thereby effected a taking under the Fifth and Fourteenth Amendments for which it must compensate the business owner?

There are good arguments for getting to yes. Because the orders would be characterized to effect an alleged regulatory (rather than physical) taking, a fact-intensive, multi-factor analysis applies. While public health and safety justifications would be given substantial weight by the courts, the unprecedented nature of the crisis and sweeping closure orders leave room to develop arguments that the orders effect a taking by barring a select group of property owners from using their property for the good of everyone in the state.

The Takings Clause

The Fifth Amendment’s Takings Clause, made applicable to the states through the Fourteenth Amendment, states: “nor shall private property be taken for public use, without just compensation.” “The Takings Clause is designed to bar Government from forcing some people alone to bear public burdens which, in all fairness and justice, should be borne by the public as a whole.” Ark. Game & Fish Comm’n v. United States, 568 U.S. 23, 31 (2012) (internal quotation marks omitted).

Framework For Analyzing Regulatory Takings

The U.S. Supreme Court has long recognized that a taking may be effected not only by the government’s physical occupation or appropriation of private property, but also by regulation that “‘goes too far.'” Tahoe-Sierra Pres. Council v. Tahoe Reg’l Planning Agency, 535 U.S. 302, 326 (2002) (quoting Justice Holmes’ opinion in Penn. Coal Co. v. Mahon, 260 U.S. 393, 415 (1922)). Since the COVID-19 shut-down orders do not involve the states in physically occupying or appropriating property, the question of whether the orders effect a taking is analyzed under the Court’s regulatory takings jurisprudence.

Regulatory takings, in turn, come in two varieties. First, there are categorical takings such as “where regulation denies all economically beneficial or productive use of land.” Lucas v. South Carolina Coastal Council, 505 U.S. 1003, 1015 (1992). The Court has cautioned that this kind of regulatory taking is likely to be “rare,” id. at 1018, because it requires a complete and permanent elimination of value. See also Tahoe Sierra Pres. Council, 535 U.S. at 332 (“Lucas was carved out for the ‘extraordinary case’ in which a regulation permanently deprives property of all value.”). Enactments that fall outside this limited category are analyzed under the fact-specific standard established in Penn Central Transp. Co. v. City of New York, 438 U.S. 104 (1978), a case that arose from New York City’s denial of a permit to build an office tower above Grand Central Terminal based on the train station’s designation as a historic landmark.

While there is no “‘set formula’ for evaluating regulatory takings claims,” Penn Central is understood to have identified “several factors that have particular significance,” namely “‘the economic impact of the regulation on the claimant;'” “‘the extent to which the regulation has interfered with distinct investment-backed expectations;'” and “the ‘character of the governmental action–for instance whether it amounts to a physical invasion or instead merely affects property interests through ‘some public program adjusting the benefits and burdens of economic life to promote the common good.'” Lingle v. Chevron U.S.A. Inc., 544 U.S. 528, 538-39 (2005) (quoting Penn Central, additional internal quotations omitted). (Applying this analysis the Penn Central Court rejected the plaintiffs’ contention that a taking resulted from application of the New York City landmarks law to forbid the building of the office tower, see 438 U.S. at 138.).

Business owners shut down by COVID-19 closure orders will have strong arguments on the first two Penn Central factors, given the severe economic impact and lack of foreseeability of the global pandemic. Courts, however, can be expected to give significant weight to the public health and safety justifications for the closure orders in examining the character of the government’s action (third factor), potentially tilting the Penn Central analysis in the government’s favor. See, e.g., Nat’l Amusements, Inc. v. Borough of Palmyra, 716 F.3d 57, 63 (3d Cir. 2013) (no taking in temporary closure of flea market to allow for identification of unexploded munitions under parking lot due to safety threat of munitions); Rose Acre Farms, Inc. v. United States, 559 F.3d 1260, 1283 (Fed. Cir. 2009) (no taking in USDA regulation barring sale of eggs from salmonella-infected chickens that prohibited plaintiff from selling eggs from certain facilities for 25 months even if chickens were not infected; “potential for physical harm to the public is significant,” as “infected eggs could have caused serious illness and possibly even death”); Brakke v. Iowa Dep’t of Natural Resources, 897 N.W.2d 522 , 526, 550 (Iowa 2017) (no taking in emergency state agency order mandating quarantine of hunting preserve “for five years after whitetail deer harvested on the property tested positive for chronic wasting disease;” although order rendered land unusable as hunting preserve, purpose of order was “to protect wildlife in Iowa from a potentially contagious disease”).

Nonetheless, the court’s objective in weighing the Penn Central factors is to determine whether “it is unfair to force the property owner to bear the cost of the regulatory action.” Rose Acre Farms, Inc. v. United States, 559 F.3d at 1282. The unprecedented nature of the COVID-19 crisis and breadth of the individual closure orders leave room for novel arguments. Should the states’ differential treatment of businesses deemed essential versus non-essential be a factor in the analysis? Should public health missteps that arguably gave rise to the need for sweeping action–such as a lack of testing and initial advice against wearing masks–be a factor? Can the court look behind the public health and safety justification to ask whether similar safety effects could have been achieved through a more narrowly tailored order that would have been less devastating to the property owner? Does the absence of traditional scientific evidence underlying the closure orders diminish the public health justification? We should hope that any court hearing a COVID-19 takings claim takes to heart the Supreme Court’s repeated reminders that the analysis requires “essentially ad hoc, factual inquiries” that are “designed to allow careful examination and weighing of all the relevant circumstances.” Tahoe-Sierra Pres. A lawsuit filed recently to challenge shelter in place orders in Pennsylvania explained that although such orders may be necessary they are nevertheless Government seizures of people’s livelihoods and businesses that have forced indefinite closures and widespread layoffs. The suit correctly described the government’s actions as “uncompensated takings” that violate the Takings Clause of the 5th Amendment. That is, the government is legally obligated to properly compensate citizens for their tangible losses - and this does not mean some bullshit $1200 check. The suit says:

‘Without extending constitutionally required just compensation to Plaintiffs and those similarly situated, [shelter in place] Orders jeopardize the sustainability of many businesses and the livelihoods those businesses provide to individuals.’ [MORE]

Roughly 5 percent of residents — or about 420,000 people — left the city between March 1 and May 1. In the city’s very wealthiest blocks, in neighborhoods like the Upper East Side, the West Village, SoHo and Brooklyn Heights, residential population decreased by 40 percent or more, while the rest of the city saw comparably modest changes.

Some of these areas are typically home to lots of students, many of whom left as colleges and universities closed; other residents might have left to care for friends or family members across the country. But, on average, income is a strong simple predictor of a neighborhood’s change: The higher-earning a neighborhood is, the more likely it is to have emptied out.

Relatively few residents from blocks with median household incomes of about $90,000 or less (in the 80th percentile or lower) left New York. This migration out of the city began in mid-March, and accelerated in the days after March 15, when Mayor Bill de Blasio announced that he was closing the city’s schools.

According to the Institute for Policy Studies America’s Billionaires Increased their Wealth by 12.5% During the COVID Lockdown

From [MintPress] America’s billionaires have seen their wealth increase by 12.5 percent during the COVID-19 lockdown period. The Institute for Policy Studies (IPS), a Washington, D.C.-based think tank, released a study Thursday showing that, in the eight weeks between March 18 and May 14, the country’s super wealthy have added a further $368.8 billion to their already enormous fortunes. 

Among the more famous big winners during the pandemic include Facebook co-founder Mark Zuckerberg, who adds $21 billion to his net worth (a 38 percent increase). Failed Democratic presidential contender Michael Bloomberg is up $10 billion as well, meaning he has recouped ten times as much as he lost in his big money political campaign that went nowhere. Microsoft co-founder Bill Gates has increased his fortune by around $6 billion as well. 

All this comes at the same time that the economy has undeniably imploded for working people. A record 36 million Americans have filed for unemployment insurance, with millions more losing their employer-based healthcare plans, and around a third of the country not paying its rent. Schools, factories, offices, and other businesses remain shuttered. The Trump administration has promised to provide $1,200 to every citizen, but it will be months before everyone receives their check. As a result, there has been an explosion in the use of food banks, as desperate citizens line up for hours in the hopes of receiving a box of food. 

The study, based on figures from Forbes’ annual global billionaire survey, found that Amazon CEO and world’s richest individual Jeff Bezos was the biggest winner during the period of crisis, adding a massive $30 billion to his wealth. If he continues at the current rate, Bezos will become the world’s first trillionaire by 2026, with other oligarchs not far behind. This is possible primarily because of the hyper-exploitation of his workforce; Amazon warehouse employees are infamously forced into wearing adult diapers or peeing in bottles, unable to take bathroom breaks. The company’s own data shows that one-third of its Arizona employees depend upon food stamps to make ends meet. In Pennsylvania, it is the state’s nineteenth largest employer but fifth most common for those receiving SNAP benefits. Bezos’ workers have been organizing amid a pandemic that puts their lives at risk, but instead of providing them with living wages and proper protective equipment, he has given his employees at Whole Foods supermarkets with new uniforms proclaiming that they are heroes.

From [HERE] The Indiana Supreme Court on Monday denied a request from Indiana Gov. Eric Holcomb [R] to clarify whether Attorney General Curtis Hill [R] should be removed from office because of the 30 day suspension of his law license. 

The governor in a May 12 motion asked the court whether Hill's suspension, which began Monday, would result in his removal. If Hill is removed, according to the court filing, the governor wanted to appoint a new attorney general.

Curtis Hill is the first African American man to become Indiana Attorney General. In 2018, Hill was accused of sexual misconduct by four white women, prompting calls for his resignation. Hill has denied the allegations. A subsequent investigation by a special prosecutor found the allegations credible, but also found that there was insufficient evidence to convict Hill of a crime. Indiana's Supreme Court, however, suspended Hill from his duties for a period of 30 days beginning on May 12, 2020, because of the allegations. [MORE]

In 2016, Hill ran as a Republican for Indiana attorney general, seeking to succeed Greg Zoeller, who did not seek reelection. Hill ran against former Lake County Circuit Court Judge Lorenzo Arredondo, the Democratic nominee.[10] Hill significantly outspent Arredondo in the race.

In the 19 months since he put his hand on a Bible and was sworn in as Indiana’s first black male attorney general, he has made headlines here and around the country for a string of provocative positions. From [HERE] Chris is an inmates serving time for a nonviolent felony at the Northeast New Mexico Correctional Facility. He said since the coronavirus outbreak, things have been tense on his cell block.

“There's 60 men to a pod and we have two man cells and there's 30 on bottom, 35 on bottom, 30 on top,” Chris told KOB 4.

Chris said the men on his cell block have masks, but sometimes soap and other sanitizing products are hard to come by.

“It’s completely defeating the purpose. They're taking measures just to say they took measures. They're not doing anything to help us and everyone knows that,” Chris said.

Chris said he thinks the best solution right now is to decrease the prison population. Gov. Lujan-Grisham has already granted permission for some inmates to be released up to 30 days early.  

“We’re still working based on that executive order from April 6 to look at those folks who meet criteria based on their offenses and are 30 days from release,” said Eric Harrison, with the State Department of Corrections.

Harrison said he knows there are valid concerns from inmates and that state officials are taking them seriously. [MORE]

According to the Guardian, China has gone a month without announcing any new deaths from the coronavirus. 

The National Health Commission reported four new cases of the virus Friday, all local cross-infections in the northeastern province of Jilin where a cluster of uncertain origin has been detected in recent days. The last time the commission reported a death was on 14 April.

Just 91 people remain in treatment for Covid-19 and 623 others are under isolation and monitoring for being suspected cases or for having tested positive without showing symptoms, including 11 newly detected.

In total, China has reported 4,633 deaths among 82,933 cases since the virus was first detected late last year in the central city of Wuhan.

China has maintained social distancing and bans on foreigners entering the country, but has increasingly opened up the world’s second-largest economy to allow both large factories and small businesses to resume production and dealings with customers. The government plans to hold the ceremonial parliament’s annual session later this month, but with highly limited access for journalists and others. [MORE]
