Racist Suspect John Spooner is accused of murdering Darius Simmons, an unarmed black 13 year old in front of his mother in an unprovoked shooting in the front of her home on May 31 in Milwaukee. After the murder, even though Spooner confessed to the murder, the police searched the mother's home, detained her for hours and arrested her other son. Then he changed his mind and requested a jury trial - and to possibly avoid non-white jurors in Milwaukee he now wants to change court location. Circuit Judge Jeffrey A. Wagner set a Dec. 21 hearing date to rule on the motion to change venue or impanel a jury from another county. Spooner's case remains scheduled for trial in January.  Prosecutors will have to file a reply to the motion prior to that hearing date. A brief supporting the motion suggests that news reports about the case have inflamed public sentiment toward the case and biased potential jurors against Spooner, citing comments readers have left to online versions of news reports. President Obama has reiterated “US support for Israel’s right to self-defense.” Obama discussed the escalating violence in the Gaza Strip with Israeli PM Benjamin Netanyahu on Friday. He also expressed regret over the loss of Israeli and Palestinian civilian lives. White Federal judge upholds motorist provision of South Carolina immigration law - Non-Whites Can be Detained on Side of Road while Police Check Status

From [HERE]  and [HERE] A judge for the US District Court for the District of South Carolina on Thursday upheld [order, PDF] a provision of South Carolina's controversial immigration law [SB 20, materials] that permits law enforcement officers to check the immigration status of motorists. Judge Richard Gergel (in photo), who is a white man, ruled that he would still prevent certain parts of the immigration law from taking effect. Gergel heard arguments Tuesday on the part of South Carolina's controversial immigration law that permits law enforcement officials to detain motorists on the side of the road for a "reasonable amount of time" while the officer checks the driver's immigration status. During arguments, Gergel asserted that 90 minutes is too long to detain a vehicle, but that 38 minutes could be considered reasonable and may not violate the constitutional protections against unlawful searches and seizures conferred by the Fourth Amendment .

Similar to Arizona's "show me your papers" law, the SC law cannot be enforced without racially targeting persons perceived by officers to be undocumented (all non-white persons or specifically, people with brown/black skin and/or an accent or any other stereotypical characteristic the officer has been indoctrinated with) in violation of the Fourth Amendment’s protection against unreasonable searches and seizures and the Fourteenth Amendment’s Equal Protection Clause. This provision of SB 20 is an unconstitutional “stop-and-identify” law that converts detentions into de facto arrests where officers rely on hunches and other impermissible factors in assuming that a person is in the country illegally.

The Southwest Shooting Authority, a gun store in Pinetop, Ariz., has published an ad its local paper following the presidential election declaring that Obama voters are barred from their establishment.

“If you voted for Barack Obama, your business is NOT WELCOME at Southwest Shooting Authority. You have proven you are not responsible enough to own a firearm,” reads the full text of the ad.

“It is about the direction that this country is going and the direction it’s been going for the last four years, and I feel like the people that voted for him are by and large the ones that are on the many entitlements and free stuff that they’ve been getting,” the store’s owner, Cope Reynolds, who is a white man, told the Huffington Post.

“If someone really believes that this country can get any stronger and do any better under the leadership of Barack Obama, then I don’t feel like they’re responsible enough to own a gun,” he added. "Dwight Power!": N.C. White Supremacist Parade Interrupted by Clown Counter-Racist Protest, outnumbered 5 to 1

From [HERE] A gathering of white supremacists attempting to promote an anti-immigrant message at a rally in Charlotte, N.C. was largely drowned out by a clown-themed counter-protest over the weekend.

WCNC reports that members of the National Socialist Movement and Ku Klux Klan ended up being outnumbered by at least five to one as they spoke out against Charlotte's growing Latino population, which they claimed was being largely bolstered by illegal immigration. The mocking counter-demonstration was organized by the Latin American Coalition, which said it was an attempt to underscore the absurd and hateful nature of the rally.

The protesters, many of them wearing red clown noses or face paint, played off the "white power" message of their opponents, throwing "white flour" in the air and holding up "wife power" signs.

It is great when white people reveal that they are white supremacist because it is difficult for non-white people to "always determine who is a racist, and who is not - as it is impossible to monitor (or judge) all the individual actions and words of any white person at all times." What is a “Racist Suspect?”

ANY white person who is CAPABLE of practicing racism against non-whites. What is a “White Supremacist?”

A white person (a racist) who practices racism against non-whites. Over the past four years, Fox News employees have aggressively campaigned for Republican candidates. A Media Matters report found that leading up to the 2012 presidential election, over 32 Fox hosts and contributors campaigned for GOP candidates in more than 300 instances, nationally and in more than 40 states. Among them was Fox contributor Karl Rove, whose American Crossroads and Crossroads GPS promised to spend $300 million on ads for conservative candidates.

The same report revealed that five Fox figures advised Mitt Romney's campaign, and nine -- including John Bolton and Mike Huckabee -- "played key roles" at Romney events.

During the 2010 election cycle, more than 30 Fox hosts and contributors endorsed, fundraised, or campaigned for Republican candidates. According to a Media Matters report, those candidates often highlighted the support they had received from Fox.

Romney, the largest beneficiary of Fox News campaigning, was often advised by Fox's on-air personalities about what he should do. For instance, Bill O'Reilly said that Romney should "keep pounding" the message that Obama "doesn't like this capitalistic system." Fox & Friends co-host Gretchen Carlson said that Romney could create a "pretty compelling campaign ad" by juxtaposing Obama saying he had three years to fix the economy with him saying he needs another four years.

The Administration of No Justice: Indifferent, Clown Court Appointed Attorneys & the Constitutional Right to Defense Counsel

No justice at all

As a result of the failure of many states to meet their constitutional obligations under Gideon, it is generally acknowledged that the kind of justice one receives depends very much on the amount of money one has, contrary to Justice Black's statement in Griffin v. Illinois and the phrase "Equal Justice Under Law" engraved on the Supreme Court building.

The difference is evident from the start. A person who can afford to retain a lawyer usually does so within hours of arrest, and the lawyer may secure the client's release shortly thereafter. People who cannot afford a lawyer may spend weeks or months in jail before being assigned a lawyer. Those who can afford a lawyer receive individual representation. Those who cannot afford a lawyer are often processed through the courts with only a few minutes of a lawyer's time.

But of far greater consequence of inadequate representation is the ultimate outcome of the case. The exoneration of over 100 people previously sentenced to death and the release of even more people as a result of DNA evidence has demonstrated the most drastic consequence of inadequate representation -- conviction of the innocent. In many courts, it is far better to be rich and guilty than poor and innocent.

II (1931). From [HERE] A Black man described by a prosecutor as "a serial killer in training" was executed Thursday in Texas for a woman's slaying during a break-in at her home a decade ago.

Mario Swain, 33, received a lethal injection for killing Lola Nixon at her home in East Texas' Longview two days after Christmas in 2002. When asked by a warden if he had a final statement before his punishment, the condemned prisoner shook his head, closed his eyes and took several barely audible breaths. Within a moment, all movement stopped. Swain was pronounced dead 30 minutes later, at 6:39 p.m. CST.

No family members or friends of Nixon were at the execution. Swain also had no relatives among the witnesses. Swain's attorney, James Volberding, said no late attempts were made in the courts to block the execution, the 13th this year in the nation's busiest capital punishment state.

The U.S. Supreme Court last month refused to review the case, and the Texas Court of Criminal Appeals last week rejected an appeal that contended a prison expert's testimony during the sentencing phase of Swain's 2003 capital murder trial was false and misleading.

Never be a Black Criminal Defendant: Despite Judicial Finding that DA Suppressed Evidence of Innocence, White Prosecutors Appeal Black Man's Voided Murder Conviction

[MORE] From [HERE] Prosecutors decided Wednesday not to put George Allen back on trial for a 1982 murder, but hours later the Missouri attorney general’s office said it would appeal a judge’s ruling that overturned Allen’s conviction. The state also is asking for an emergency order to keep Allen, 56, in prison until the Western District of the Missouri Court of Appeals can decide the matter. There is no timeline for what happens next.

“We believe the facts and circumstances of the case and the trial court’s findings should be examined by the appellate court as part of the normal safeguarding process,” the attorney general’s office said in a prepared statement. Barry Scheck of The Innocence Project, which took on Allen’s case along with the Bryan Cave law firm in St. Louis, called the attorney general’s move “disgraceful.”

“This is an overwhelming case of suppression of exculpatory evidence of actual innocence, (plus) a clearly false confession taken from a mentally disturbed person,” Scheck said. “The appeal is wholly without merit and just cruel.”

In a 75-page ruling on Friday, Cole County Circuit Judge Daniel Green voided Allen’s convictions for murder, rape, sodomy and first-degree burglary in the killing of 31-year-old Mary Bell. She was slain Feb 4, 1982, in her apartment in the LaSalle Park neighborhood.

Don't Blame GOP: White Democratic Voters Also Do Not Wait in Line

As if voting is something new. As if white supremacy is just a Republican thing. Right. Just like driving or walking (while Black or Brown), banking, getting an education and everything else of perceived value in the US seems to go down differently for non-whites. White people can barely wait in line at the CVS behind a Black person - they do not accept waiting in line to vote. White people in white Democratic precincts did not wait in line for 6 hours to vote for Obama. If so, where? If you waited in line you most likely are non-white. This is purposeful, strategic behavior by white people. The "we're all in this together" stuff is a game. The current operating system of White supremacy is the problem not technology or the GOP. 

A Hart Research study sponsored by the AFL-CIO found wait times to vote were significantly longer for Latinos and Blacks this year as 24% and 22% respectively waited in line longer than whites who voted. [actual study is HERE - just a graph, pictured above "Minorities, Democrats...". By the way, who is a minority when 90% of the world is non-white?]  

A different survey by MIT in 2008 found that wait times for black voters were more than twice as long as those for whites. This was for both early and election day voting.

A fast-spreading emerging edict on what Republicans need to do to appeal to Hispanic voters is that they need – really need – Latinos in their party like Sen. Marco Rubio.

Many pundits and other political observers believe that if Republicans have more Rubios, and give them more of the spotlight, it will undo the off-putting image of the party as one of out-of-touch older, Anglo men who cannot empathize or sympathize with most Americans. And with a Latino front and center, the emerging conventional wisdom goes, Republicans will cease to be written off by Latinos as being against them. “If there's a winner tonight, it's the Senator from Florida, Marco Rubio,” said conservative columnist George Will in a television interview on Election Day after President Obama was declared the winner, “because all eyes are now going to be turned to him as a man who might have a way to broaden the demographic appeal of this party."

Mitt Romney took most of the white vote, which is 72 percent of the electorate. But it wasn't enough. President Obama was reelected Tuesday night in large part because of strong support from women and minorities. The lesson of his victory for both parties, but particularly Republicans, may be this: The primacy of white male voters has passed. In the modern era, it takes a diverse coalition to win the White House.

Look at the basic breakdown of Mr. Obama’s victory, according to exit polls (which may yet be revised). He won 93 percent of African-Americans, 71 percent of Hispanics, and 73 percent of Asians. He took 55 percent of the overall female vote, down only one percentage point from his comparable 2008 showing.

Mitt Romney, meanwhile, won about 59 percent of the white vote. That’s the best a GOP nominee has done among whites since 1988, and not too long ago such a performance might have guaranteed a winning margin of 270 electoral votes. After all, whites still make up 72 percent of US voters.

But that percentage has inexorably grown smaller election by election. In 2008 whites were 74 percent of the electorate. Given Obama’s popularity among minorities, Mr. Romney would have needed the support of even more whites to win – and Obama did well (or well enough) among white women, particularly single and young white women.
