Black farmer group petitions to intervene in Texas debt relief lawsuit

From [HERE] A group of Black farmers is seeking to jump into the Texas federal court battle that has stalled a $5 billion debt relief program for farmers of color.

The motion to intervene filed on Tuesday by the Federation of Southern Cooperatives/Land Assistance Fund includes declarations from six farmers alleging discrimination from the Agriculture Department and Farm Service Agency loan programs.

The farmers argue that debt relief is key to their businesses’ survival and that Agriculture Secretary Tom Vilsack and his Justice Department attorneys can’t be counted on to defend the debt relief program as vigorously as the Black farmers federation will.

“Its members realize the benefits from the program and that the constitutionality of racial justice programs be upheld,” wrote the group’s attorneys with the Lawyers' Committee for Civil Rights Under Law. “Although the Federation’s members will be most impacted by the outcome of this case, the record is currently devoid of any stories or narratives of Black farmers or other farmers of color. … It is certain that the Federation will present the case of past governmental discrimination more comprehensively and compellingly than the government has to date.”

Background: The lawsuit at hand, Miller v. Vilsack, was first filed by Texas Agriculture Commissioner Sid Miller, who argued that the program unconstitutionally discriminates against white farmers. The suit, backed by an organization led by former Trump adviser Stephen Miller, came about a month after the debt relief was passed by Congress in the March Covid-19 relief package.

In July, Federal District Judge Reed O’Connor issued a preliminary injunction concluding that the program is probably unconstitutional and ordering USDA to not issue any payments until litigation is complete.

The Texas case is one of a slew of legal challenges to the program. A federal District Court in Florida was the first to issue a preliminary injunction, and a judge in Wisconsin issued a temporary restraining order.

The Justice Department, defending the program on behalf of USDA, opted not to appeal the first preliminary injunction issued or similar orders in other cases. [MORE]

2020 Census may have undercounted Black Americans, new analyses say

Two new analyses suggest the 2020 Census may have undercounted Black people at a significantly higher rate than usual, raising concerns about whether minority communities could lose out on fair representation and funding over the next 10 years.

The Census Bureau has not yet released data that would allow comparisons of 2020 Census results with earlier estimates to assess the survey’s accuracy. But a simulation comparing the bureau’s estimates for 2020 with results from 2010 indicates that the country’s Black population may have been undercounted at a rate up to three times as high as in 2010. And a second report suggests the undercount of Black children could be up to 10 times as high as a decade ago.

The findings align with concerns that some jurisdictions and civil rights advocates have had about lower-than-expected totals in the 2020 Census.

If the analysis holds up, that means the 2020 Census count of people who identified as Black alone could be approximately 2 million lower than it should be. The undercount could have profound implications for a wide array of services that are based on population counts, including Medicaid and Medicare, the Supplemental Nutrition Assistance Program (SNAP), highway planning and construction, Section 8 housing vouchers and Head Start.

“This might be our greatest undercount since 1960, or 1950,” said Marc Morial, president and chief executive of the National Urban League, which sued the bureau last year to stop the count from ending early.

Even in the best of times, the census tends to overcount some populations and undercount others, with the highest undercounts among minorities, renters, low-income people and children. But the 2020 Census was fraught with challenges, including Trump administration efforts to add a citizenship question, the coronavirus pandemic, natural disasters, and legal battles over the count’s end date. All of these raised concerns among experts about whether the undercounts would be more significant this time.

“It was a perfect storm for an undercount on multiple levels,” said Rep. Brenda Lawrence (D-Mich.). Many people in poor and minority communities are already reluctant to respond to questions about their household members, a problem that was exacerbated by the additional challenges, she said. “I’m hopeful that the official numbers are not as low as the ones that the analysts are putting out, but the numbers that we’ve seen from these analysts are disturbing.”

The simulation, an independent analysis conducted by Connie Citro, a statistician who is also a senior scholar at the Committee on National Statistics at the National Academies of Sciences, Engineering, and Medicine, presents three possibilities for a net undercount of people who check Black and no other race, based on the bureau’s low, middle and high independent population estimates released in December. Citro calculated a net undercount of between 3.24 and 7.25 percent, compared with a 2.3 percent net undercount for that group in 2010.

For people who check Black in combination with other races, Citro’s analysis found a range between a 0.28 percent overcount and a 4.36 percent undercount, compared with a 1.1 percent undercount for that group in 2010.

The full extent of the survey’s undercounts and overcounts will become clearer next year when the bureau releases what is known as its modified race file, a tally that reassigns people who marked “some other race” alone into Black and non-Black categories. A post-enumeration survey, conducted by the bureau after each decennial census, will further assess the accuracy of the 2020 count. [MORE]

What does 95% COVID-19 vaccine efficacy really mean?

It is imperative to dispel any ambiguity about how vaccine efficacy shown in trials translates into protecting individuals and populations. The mRNA-based Pfizer12 and Moderna3 vaccines were shown to have 94–95% efficacy in preventing symptomatic COVID-19, calculated as 100 × (1 minus the attack rate with vaccine divided by the attack rate with placebo). It means that in a population such as the one enrolled in the trials, with a cumulated COVID-19 attack rate over a period of 3 months of about 1% without a vaccine, we would expect roughly 0·05% of vaccinated people would get diseased. It does not mean that 95% of people are protected from disease with the vaccine—a general misconception of vaccine protection also found in a Lancet Infectious Diseases Editorial.4 In the examples used in the Editorial, those protected are those who would have become diseased with COVID-19 had they not been vaccinated. This distinction is all the more important as, although we know the risk reduction achieved by these vaccines under trial conditions, we do not know whether and how it could vary if the vaccines were deployed on populations with different exposures, transmission levels, and attack rates.

Simple mathematics helps. If we vaccinated a population of 100 000 and protected 95% of them, that would leave 5000 individuals diseased over 3 months, which is almost the current overall COVID-19 case rate in the UK. Rather, a 95% vaccine efficacy means that instead of 1000 COVID-19 cases in a population of 100 000 without vaccine (from the placebo arm of the above mentioned trials, approximately 1% would be ill with COVID-19 and 99% would not) we would expect 50 cases (99·95% of the population is disease-free, at least for 3 months).

Accurate description of effects is not hair-splitting; it is much-needed exactness to avoid adding confusion to an extraordinarily complicated and tense scientific and societal debate around COVID-19 vaccines.

John Gruden Forced Out as Raiders Coach After a History of Making Anti-Black, Women and Gay Comments. Although the NFL Fully Participates in the System of White Supremacy, Bigotry is Off Limits

From [HERE] and [HERE] Jon Gruden stepped down Monday as the coach of the Las Vegas Raiders football team hours after The New York Times detailed emails in which he had made homophobic and misogynistic remarks, following an earlier report of racist statements about a union leader.

The resignation of Gruden, one of the league’s most prominent coaches over the past two decades, is the fallout from a long-running league investigation surrounding the workplace culture at the Washington Football Team. That probe surfaced emails that captured Gruden—in emails with former Washington team president Bruce Allen—making offensive comments about Black and gay people. 

“I have resigned as Head Coach of the Las Vegas Raiders,” he said on Twitter in a statement issued by the team. “I love the Raiders and do not want to be a distraction. Thank you to all the players, coaches, staff, and fans of Raider Nation. I’m sorry, I never meant to hurt anyone.”

Mark Davis, the owner of the Raiders, said in a statement that he had accepted the resignation. Rich Bisaccia, the Raiders’ special teams coordinator, was elevated to interim head coach, the team said.

The Wall Street Journal reported Friday that Gruden had used a racial trope to describe NFLPA executive director DeMaurice Smith in a 2011 email that said: “Dumboriss Smith has lips the size of michellin tires.” The league said it had been “informed of the existence of emails that raised issues beyond the scope of that investigation.” 

Gruden’s problems worsened on Monday night, when the New York Times reported that Gruden also used offensive language in numerous other instances. He referred to NFL commissioner Roger Goodell as a “faggot” and wrote that Goodell should not have pressured then-St. Louis Rams coach Jeff Fisher to draft “queers,” alluding to the team’s draft pick of Michael Sam in 2014. The emails’ contents were confirmed by The Journal.

He denounced the emergence of women as referees, the drafting of a gay player and the tolerance of players protesting during the playing of the national anthem, according to emails reviewed by The Times.

Gruden’s messages were sent to Bruce Allen, the former president of the Washington Football Team, and others, while he was working for ESPN as a color analyst during “Monday Night Football.” In the emails, Gruden called the league’s commissioner, Roger Goodell, a “faggot” and a “clueless anti football pussy” and said that Goodell should not have pressured Jeff Fisher, then the coach of the Rams, to draft “queers,” a reference to Michael Sam, a gay player chosen by the team in 2014.

In numerous emails during a seven-year period ending in early 2018, Gruden criticized Goodell and the league for trying to reduce concussions and said that Eric Reid, a player who had demonstrated during the playing of the national anthem, should be fired. In several instances, Gruden used a homophobic slur to refer to Goodell and offensive language to describe some N.F.L. owners, coaches and journalists who cover the league.

The terms "racist" and "racists" and racism are used interchangeably or confusingly by racists with what is really bigotry or just name calling. Amos Wilson explained that defining racism in terms of attitude or bigotry leads to solving the wrong problems. There is no system of Black supremacy. Nelly Fuller has observed that there is only one functioning form of racism in the known world- White supremacy. He challen­ges his readers to identify and then to demonstrate the superiority or functional supremacy of any of the world's "non-white" peoples over anyone. Concluding that since there is no operational supremacy of any "colored" people, Fuller reveals that the only valid operational definition of racism is white supremacy. He observes that in spite of any and all statements the world's "non-white" peoples may make about themselves having economic and/or political independence and the like, in the final analysis, they are all victims of the white supremacy process.

In a system of white supremacy/racism non-whites cannot be racist to whites b/c they have no power to do so. It is a white over Black system of vast unequal power by design.

Gullible victims of RSW who have misunderstood the meaning of racism white supremacy have sought to reform the conduct of racists - reform their bad attitudes & behavior, mean words, stereotypes and prove their humanity to them through moral suasion. Such goals can be described as a moral quest for respect from racists and for more kinder & thoughtful white people. However, asking master "to do the right thing" misses the point entirely. At this point in history said goals are entirely pathological and perhaps even a sign of a mental disorder. The master-servant relationship must be destroyed, not updated and refined. 

Justice requires the elimination of the causes of injustice.  White Supremacy/Racism is the cause of problems such as poverty, economic inequality, lack of economic development, unemployment, drug addiction, infant mortality, AIDS, health disparities, chronic welfare dependency, lack of affordable housing, gentrification, homelessness, servant education, the unequal administration of justice, police brutality, jim crow like incarceration and much more. Although the system of racism/white supremacy is a main source of all Black people’s problems and oppression, it is not part of “the resistance” or “being woke” or the electoral “black politics” agenda. Rather, said approaches primarily focus on single issues such as “voting rights” or “police brutality” etc. and the unequal administration of laws in general as independent “civil rights” issues examined outside the context of racism/white supremacy. Said lens views issues separately and not as symptoms of the system of racism/white supremacy. In reality, most Blacks examine issues on an ad-hoc basis, the way white liberals and conservatives have defined said issues for them. Therefore, discussion never concerns how to attain the power to stop racists from practicing racism against them.

CNBC reports The September jobs report showed Black unemployment dropped sharply from the prior month, but workers leaving the labor force complicated the recovery picture.

The overall U.S. unemployment rate dropped to 4.8% from 5.2%, according to the Labor Department report, better than the expected 5.1%. But jobs growth disappointed, with 194,000 nonfarm payrolls added in September, compared with the 500,000 expected.

For Black workers, the unemployment rate fell to 7.9% in September from 8.8% in August. That’s the largest drop when compared with other racial groups in the jobs report. It’s also notable considering the labor market recovery for Black Americans has lagged other groups throughout the pandemic.

However, the labor force participation rate of Black Americans also fell to 61.3% in September from 61.6% the previous month. That figure dropped just slightly for white workers, by one-tenth of a percent, and rose for Hispanic and Asian workers.
The shrinking Black labor force suggests the improved unemployment picture for Black Americans can be attributed partially to job seekers exiting the labor force rather than an indication of longer-term recovery, economists said.

“The improvement in this month’s unemployment rate is misleading given the decline in the participation rate, in particular when you look at Black men and women,” said economist Valerie Wilson a director at the Economic Policy Institute.

“I don’t think that is signaling any acceleration or improvement in the pace of recovery at this point,” Wilson added, noting the difficulty of drawing conclusions about labor market trends from month-to-month changes.

The combination of falling unemployment rates and labor force participation indicates a division in the economic recovery, according to William Rodgers, director of the St. Louis Federal Reserve’s Institute for Economic Equity.

“You have a set of people who are benefiting and being drawn into the economy and finding opportunity, but then you have another set of people who face barriers, hurdles, constraints that are putting them in positions to where they are leaving the labor force,” Rodgers said.

Unemployment benefits ended, but hiring did not surge in September

CNN reports Out-of-work Americans did not rush back into the job market after beefed-up unemployment benefits ended nationwide in September.

The labor force shrank last month for the first time since May, signaling that more people were opting to sit on the sidelines and not actively look for work, according to the federal jobs reportreleased Friday.

"If unemployment benefits were the driving force behind labor market dynamics, then you would not have seen that effect," said Gordon Gray, director of fiscal policy at the American Action Forum, a right-leaning think tank.

The jobs report, which disappointed on several fronts, came at a time when the nation was contending with both elevated levels of coronavirus cases and a return to school for millions of children.

Despite a record number of openings, employers added an anemic 194,000 jobs -- far fewer than expected for the second month in a row.

While experts caution against drawing conclusions from one or two months of data, the September jobs report provides yet more evidence that pandemic unemployment benefits did not greatly contribute to the country's labor shortage. Other factors -- including child care issues, virus fears and workers' reevaluation of their life goals -- are playing a major role in prompting people to remain at home, economists said.

The latest report undercuts the argument made by many Republicans and business owners that the nation's economic recovery was being slowed by a federal safety net they deemed too generous.

Governors in 26 states -- all but one Republican -- opted to terminate at least one of the three pandemic unemployment programs in June or July, saying it would help solve staffing shortfalls. (Courts in two states later required officials to continue the benefits through early September.)

However, after they did so, employment did not grow substantially faster in those states, previous studies and government data have found. [MORE]

From [HERE] In cities across America, police departments are getting their money back. From New York to Los Angeles, departments that saw their funding targeted amid nationwide protests over the killing of George Floyd last year have watched as local leaders voted for increases in police spending, with an additional $200 million allocated to the New York Police Department and a 3 percent boost given to the Los Angeles force.

The abrupt reversals have come in response to rising levels of crime in major cities last year, the exodus of officers from departments large and small and political pressures. After slashing police spending last year, Austin restored the department’s budget and raised it to new heights. In Burlington, Vt., the city that Senator Bernie Sanders once led as mayor went from cutting its police budget to approving $10,000 bonuses for officers to stay on the job.

But perhaps nowhere has the contrast been as stark as in Dallas, where Mr. Johnson not only proposed to restore money to the department but moved to increase the number of officers on the street, writing over the summer that “Dallas needs more police officers.”

“Dallas stands out for the amount of investment that the local government is putting into the department,” said Laura Cooper, the executive director of the Major Cities Chiefs Association.

After the mayor proposed increasing funding, no protests followed. When the Council backed a budget that restored many of the cuts made last year, few came to the public hearing, and even fewer spoke against the plan, which included the hiring of 250 officers. It passed with little fanfare last month.

In prioritizing public safety, Mr. Johnson, a Democrat, had drawn a connection between his approach and that of other Black leaders, like Eric Adams, the Democratic mayoral nominee in New York, who see the police as a necessary part of helping neighborhoods racked by crime. And he has drawn on his experience growing up in Black neighborhoods of Dallas.

Study Finds a Crisis of Confidence in America’s Tap Water. The Sharpest Level of Distrust in Drinking Water Provided by the Government is in Black and Latino Communities

From [HERE] Distrust of tap water is on the rise in the U.S. In 2018, roughly 60 million Americans didn’t drink their tap water, according to a study led by a researcher at Pennsylvania State University—a 40% increase compared with four years earlier.

The rise, which was sharpest in Black and Hispanic communities, followed the drinking-water crisis that broke out in Flint, Mich., in 2014, when a change in the city’s water source led to complaints of brown, foul-smelling water. Despite early assurances by state and federal officials that the water was safe, scientists found that it contained extraordinarily high levels of lead, a potent neurotoxin. The public health emergency hit a city already struggling with crime, job loss and a shrinking population that could barely support its infrastructure.

Flint’s water crisis was widely publicized, but it is hardly unique: Washington, D.C., Chicago and Newark have also grappled with lead in their water systems. In the past decade, drinking water emergencies struck Toledo, Ohio, and Charleston, W.Va., where residents were told not to drink or bathe in the water in their homes. State governments had to ship bottled water by the tractor-trailer load to hundreds of thousands of people.

“The fundamental problem with drinking water is that we are continuing to live off the investments of our great-grandparents,” said Erik Olson, a senior director at the Natural Resources Defense Council, an environmental group. “Most drinking water to this day is still being delivered through pipes that are many decades old and being treated using World War I-era technology.” [MORE]

Because the latest Public Health data shows that Covid-19 vaccinated people have accounted for 81% of Covid-19 deaths this summer, whilst UK Government data shows that Covid-19 deaths are over 11 times higher than this time last year, and Office for National Statistics data shows that since teens were first given the Covid-19 vaccine there has been a 63% increase in deaths among teen boys compared to the same period in 2020. 

The UK is essentially in the midst of a national disaster with a vaccine programme that has clearly failed, but more worryingly has also killed children, and will kill more. because we seem to have a problem in the UK where a huge majority of the population do not believe a single thing unless it is shown on the BBC News. 

But the data could not be more clear. Just take a look at Public Health Scotland’s latest Covid-19 Statistical report published September 29th. Table 18 of the report shows that the vast majority of Covid-19 deaths between August 21st and September 17th 2021 were among the fully vaccinated population with 233 deaths recorded, accounting for 77% of all Covid-19 deaths. 

Throw in the 10 deaths to have occurred among the partly vaccinated and that means the vaccinated population accounted for 81% of Covid-19 deaths in Scotland between August 21st and September 17th.

UK Health Security Agency (the sinister replacement for Public Health England) data doesn’t look much better either. Table 4 of the report published by UKHSA shows that there were 687 deaths among the unvaccinated, 110 deaths among the partly vaccinated, but a frightening 2,338 deaths among the fully vaccinated between August 30th and September 26th 2021.

This means that the unvaccinated account for just 22% of Covid-19 deaths during September 2021, whilst the vaccinated account for a disastrous 78%.

And don’t even attempt to argue that this is normal because the majority of the adult population have allegedly been vaccinated. If this were normal then how do you explain the fact that Covid-19 deaths are over twelve times higher than the same period last year when there wasn’t a Covid-19 vaccine available? 

With only a claimed 95% effectiveness (The latest UKHSA data actually shows the vaccines have a negative efficacy as low as MINUS 66 percent), you would of course expect to still see some Covid-19 deaths. But not when seasonality should be on our side, just like it was in 2020 when deaths dropped to nearly zero. 

Mix seasonality in with an effective vaccine and you would have thought the UK would have just enjoyed a Covid-19 free summer, but the reality has been far from it. [MORE]

New Petition Circulating in the UK Seeks to Make Employers who Require COVID Vaccination to be Deemed Liable for Any Vaccine Damages

During the COVID pandemic, the implementation of the vaccine rollout was voluntary and vaccines were rolled out quickly for emergency use. Manufacturers have been granted immunity from liability for damages caused by the vaccines, although compensation is available from the Government.

A number of employers have started requiring staff to undertake the medical procedure of becoming vaccinated in order to continue employment. 

As this means the employer asserting themselves over an employee's personal autonomy, responsibility is being assumed by the business/ establishment, and they should be held liable for any and all damages proven to be caused by being vaccinated. 

Freedom of choice and personal autonomy is a human right and if employees are required to be vaccinated to continue their employment then there should be clear rights to financial compensation for any adverse consequences.

From [HERE] A Black paraplegic man from Ohio has filed a complaint with the NAACP after body camera video showed police officers pulling him out of his car by his hair and arms after he refused officers' orders during a traffic stop late last month.

Officers said they pulled Owensby over because he was seen leaving a suspected drug house police were monitoring. He was not charged with any drug-related offenses.

Owensby accused the Dayton Police Department (DPD) of profiling, unlawful arrest, illegal search and seizure, and failure to read him his rights before being taken to jail, Dayton Unit NAACP President Derrick Foward said at the news conference.

"They dragged me to their vehicle like a dog, like trash," Clifford Owensby, 39, said at a news conference Sunday.

Owensby received a citation for failure to restrain a child and for having tinted glass as a result of the incident, according to court records. A child was in the car with Owensby at the time of the incident, but it is unclear if the child is related to him.

Owensby pleaded not guilty on Friday, according to his attorney James Willis.

Willis said he plans to file a civil lawsuit.

"It'll take a little time to do some investigating, but we'll probably get something filed in the next month," Willis said Monday.

CNN has reached out to the District Attorney's office to ask if Owensby will be charged.

The officers involved -- who have not been identified -- remain on duty while an investigation is underway, said DPD spokesperson Cara Zinski-Neace.

On video, Owensby tells officers to call a superior during the traffic stop

On Friday, DPD released a nearly 12-minute video of the body camera footage taken from the September 30 incident.

Officers called for a Narcotics Detection K-9 unit because they observed Owensby leave a suspected drug house in the area they had been monitoring, Dayton Police Major Brian Johns said in a recorded statement.

Johns said based on his past felony drug and weapons history coupled with their observation he had left the residence in question, the officers requested a narcotics Detection K-9 to conduct a "free-air sniff," when a dog smells around the outside of a vehicle.

"Dayton Police Department policy requires the occupants of the vehicle to exit for their own safety and safety of the K-9 officer to perform this free-air sniff," Johns said.

According to the video, shortly after the radio call, one of the officers returns to Owensby, who is in the driver's seat, and asks him to step out.

Owensby refuses, then tells the officer he can't because he is paralyzed. "I'm a paraplegic," Owensby says. "I got help getting in."

The officer tells Owensby he will assist him in getting out of the vehicle, but Owensby tells the officer not to touch him and requests the officer call a superior. The officer responds by saying he will call his superior, but Owensby must get out of the car first.

"So you can cooperate and get out of the car, or I will drag you out of the car. You see your two options here?" the officer yells at Owensby, who repeats his request for the officers to call a superior.

Seconds later, two officers grab Owensby, and rip him out. One of the officers grabs him by the arm and collar and then grabs his hair and drags him out of the vehicle. Owensby is seen in the video struggling on the pavement, yelling for help as the two officers proceed to subdue him.

Johns said Owensby was taken to a local hospital, where he was examined for possible injuries and released. The police major also said officers retrieved a bag of cash from Owensby's vehicle containing $22,450.

Owensby said Sunday the money was his savings and no weapons or drugs were found in the search. He was not charged with any drug-related offenses.

"I have nightmares," Owensby said about the arrest. "I should not have to leave out of my house every day wondering if this is going to happen to me again." [MORE]

More than 100 Haitians Found in Trailer in Guatemala as Desperate Efforts to reach U.S. Continue

Guatemalan police rescued 126 mainly Haitian migrants from an abandoned shipping container on the side of a road Saturday — highlighting how the desperate flow of people from Haiti and across South America has not abated despite the recent wave of U.S. deportations.

Guatemalan authorities said they searched the trailer around dawn after residents heard screams coming from within, the BBC reported. The shipping container was found in an area between the towns of Nueva Concepción and Cocales in the country’s south.

Police spokesman Jorge Aguilar told reporters that of the 126 undocumented people found inside, 106 were from Haiti, 11 from Nepal and nine from Ghana, AFP reported.

Police suspect they had paid to be illegally taken to the United States via Mexico by smugglers, who instead abandoned them on the road. [MORE]

Suit Says Cops, Nurse Did Nothing While John Neville was in Distress at Forsyth Jail, Saying “I can’t breathe" Over 12X as he was Restrained, Face Down. All are Also Charged w/Involuntary Manslaughter

From [HERE] A federal lawsuit filed Sept. 28 alleges that detention officers at Forsyth County’s jail not only pinned John Neville in a prone position that ultimately led to his death but also that he was denied use of an inhaler for his asthma and that officials ignored repeated signs that he was in medical distress.

According to the lawsuit, despite Neville having displayed clear signs of a medical emergency, detention and medical officials at the jail failed to take Neville to the hospital for more than an hour. The lawsuit says that a sheriff’s deputy gave a written note to EMS after Neville arrived at the hospital, asking to be informed in the event of Neville’s death and whether an autopsy would be performed.

John Elliott Neville, 56, of Greensboro, died on Dec. 4, 2019 at what is now known as Atrium Health Wake Forest Baptist Hospital in Winston-Salem. Five former detention officers — Lavette Maria Williams, Edward Joseph Roussel, Sarah Elizabeth Poole, Christopher Bryan Stamper and Antonio Maurice Woodley — and nurse Michelle Heughins have all been charged with involuntary manslaughter. No trial date has been set.

On Sept. 28, Sean Neville, John Neville’s son and the executor of his father’s estate, filed a 74-page lawsuit in U.S. District Court in the Middle District of North Carolina, which includes Forsyth County. The detention officers and the nurse are named as defendants. The lawsuit also names Wellpath LLC, the jail’s medical provider at the time of Neville’s death, Forsyth County Sheriff Bobby Kimbrough Jr. and Forsyth County.

The lawsuit makes 12 separate claims, including violations of federal civil rights laws and wrongful death. It asks for compensatory damages totaling at least $300,000 and for an unknown amount in punitive damages.

The public did not find out about Neville’s death for six months, when Kimbrough acknowledged it on June 26, 2020, prompted by questions from the Winston-Salem Journal. Local protests sparked by the Minneapolis death of George Floyd a month earlier soon turned toward demanding accountability for Neville’s death in Winston-Salem.

The Triad Abolition Project led a 49-day demonstration in Bailey Park.

Demonstrators demanded that videos of Neville’s time in custody be released, that the jail change its medical provider and that law enforcement ban the use of the prone position in which Neville was restrained.

The Winston-Salem Journal joined with other media organizations to petition for the release of body camera and jail surveillance footage of the events that led to Neville’s death. A Forsyth County judge ordered the release of the videos, which showed Neville said the words “I can’t breathe” dozens of times as he was restrained, face down, in the jail.

Just days before his death, Kernersville police arrested Neville on an outstanding warrant alleging misdemeanor assault on a female in Greensboro. He was taken to the Forsyth County Jail and, according to the lawsuit, he told jail officials he had asthma. Wellpath officials prescribed Neville an inhaler that he was to receive four times a day.

He missed two doses, and at 3:26 a.m. Dec. 2, 2019, his cellmate saw that Neville had fallen from the top bunk. He pressed a button in the cell to summon help. Heughins and detention officers came in, finding Neville on the ground, sweating, with blood on his mouth in what appeared to be a seizure-like state.

From [HERE] A 10-foot tall bronze-colored bust of George Floyd, whose murder by a police officer sparked a nationwide uprising against police brutality last year, was vandalized with gray paint Sunday morning in Union Square, according the NYPD, onlookers and the group that erected the statue. [UPDATE, October 4: The NYPD has released footage fo the suspect; more details below.]

The bust had been unveiled just three days earlier as part of a touring installation that also included sculptures of Breonna Taylor, who was killed by police in Louisville, Kentucky in March of 2020, and John Lewis, the late Congressman and civil rights activist who died last summer, shortly after Floyd was killed.

Surveillance footage around 10 a.m. captured a man on a skateboard crouching behind the bust of John Lewis mixing something in a container, then skating past the statue of Floyd, dumping the gray paint on the bust and skating away, an NYPD spokesperson said. No arrests had been made as of Sunday afternoon.

Once police officers took a report about the vandalism on Sunday morning, several volunteers as well as the producer of the installation, started scraping the gray paint away. Onlookers milled around the installation taking in the works of art, and the vandalism.

Speeding While Black: New Report on Racial Disparities in Misdemeanor Speeding Convictions

From [HERE] and [HERE] According to a RAND Corporation study, (link is external)in 25 U.S. states, motorists accused of excessive speeding can face either a criminal misdemeanor or a traffic infraction, and the charge is at the discretion of law enforcement officers and the courts. Using data on speeding violations in 18 Virginia counties over a nine-year period, researchers found large racial disparities in who was convicted of a misdemeanor.

Some of the key findings include:

Black motorists cited for speeding were almost twice as likely as White motorists to be convicted of a misdemeanor when their speed was in the range that qualified for the more serious charge.

Study in the European Journal of Epidemiology Vaccines Finds that 'Fully Vaccinated Countries Had the Highest Number of New COVID Cases'

From [HERE] A study published Sept. 30, in the peer-reviewed European Journal of Epidemiology Vaccines found “no discernible relationship” between the percentage of population fully vaccinated and new COVID cases.

In fact, the study found the most fully vaccinated nations had the highest number of new COVIDcases, based on the researchers’ analysis of emerging data during a seven-day period in September.

The authors said the sole reliance on vaccination as a primary strategy to mitigate COVID-19 and its adverse consequences “needs to be re-examined,” especially considering the Delta (B.1.617.2) variant and the likelihood of future variants.

They wrote:

“Other pharmacological and non-pharmacological interventions may need to be put in place alongside increasing vaccination rates. Such course correction, especially with regards to the policy narrative, becomes paramount with emerging scientific evidence on real-world effectiveness of the vaccines.”

As part of the study, researchers investigated the relationship between the percentage of population fully vaccinated and new COVID cases across 68 countries and 2,947 U.S. counties that had second dose vaccine, and available COVID case data.

For seven days preceding Sept. 3, researchers computed COVID cases per one million people for each country, as well as the percentage of population that was fully vaccinated.

Notably, Israel with more than 60% of its population fully vaccinated, had the highest COVID cases per 1 million people during the seven-day period.

Iceland and Portugal, with more than 75% of their populations fully vaccinated, had more COVID cases per 1 million people than countries such as Vietnam and South Africa, where only about 10% of the population is fully vaccinated.

Across U.S. counties, the median new COVID cases per 100,000 people during the seven-day period was similar across the categories of percentage of population fully vaccinated.

The researchers found a substantial county variation in new COVID cases within categories of percentage of population fully vaccinated. There also appeared to be no significant signaling of COVID cases decreasing in counties where a higher percentages of the population was fully vaccinated.

Of the top five counties with the highest percentage of population fully vaccinated (99.9% – 84.3%), the Centers for Disease Control and Prevention (CDC) identified four as “high” transmission counties.

Three of the four counties classified as “high” transmission had fully vaccinated rates of 90% or higher. Conversely, of the 57 counties classified as “low” transmission by the CDC, 15 had fully vaccinated rates of 20% or lower.

From [HERE] Data released Friday by the Centers for Disease Control and Prevention (CDC) showed that between Dec. 14, 2020 and Oct. 1, 2021, a total of 778,685 adverse events following COVID vaccines were reported to the Vaccine Adverse Event Reporting System (VAERS). The data included a total of 16,310 reports of deaths — an increase of 373 over the previous week.

There were 111,921 reports of serious injuries, including deaths, during the same time period — up 6,163 compared with the previous week.

Excluding “foreign reports” filed in VAERS, 593.728 adverse events, including 7,437 deaths and 47,455 serious injuries, were reported in the U.S. between Dec. 14, 2020 and Oct. 1, 2021.

Of the 7,437 U.S. deaths reported as of Oct. 1, 11% occurred within 24 hours of vaccination, 16% occurred within 48 hours of vaccination and 29% occurred in people who experienced an onset of symptoms within 48 hours of being vaccinated.

In the U.S., 393.4 million COVID vaccine doses had been administered as of Oct. 1. This includes: 227 million doses of Pfizer, 152 million doses of Moderna and 15 million doses of Johnson & Johnson (J&J).

The data come directly from reports submitted to VAERS, the primary government-funded system for reporting adverse vaccine reactions in the U.S.

Every Friday, VAERS makes public all vaccine injury reports received as of a specified date, usually about a week prior to the release date. Reports submitted to VAERS require further investigation before a causal relationship can be confirmed.
Historically, VAERS has been shown to report only 1% of actual vaccine adverse events.

The most recent death involves a 16-year-old male (VAERS I.D. 1734141) who reportedly died from cardiac failure five days after receiving Pfizer’s COVID vaccine.

Other recent deaths include a 17-year-old male (VAERS I.D. 1689212) with cancer who was vaccinated April 17, tested positive for COVID on July 20, was hospitalized and passed away Aug. 29; and a 16-year-old female (VAERS I.D. 1694568) who died from a pulmonary embolism nine days after receiving her first Pfizer dose.
